Justice. It seems such a simple phrase, yet hidden underneath are complexities which humanity has debated since the time of Socrates. What does justice mean? By what moral codes do we define justice? Does justice even exist beyond the human imagination? Questions like these drove me while I was a student at New Mexico State University studying for my Philosophy degree. As a result of my studies, I became fascinated by the law as a form of applied justice. I knew then that my calling was to be an attorney.. After graduating from NMSU in 2006, I decided to attend law school at Western New England University. While there I had many opportunities to immerse myself in the practice of law. I was selected to be an extern for the Honorable Robert Field of the Housing Court, a court which had jurisdiction over all civil and criminal matters involving the use of residential property. I was also selected to be a student attorney in the Consumer Law Clinic, which allowed me to represent indigent clients who had been taken advantage of by businesses or landlords.. After I graduated law school in 2010, I decided I was sick of the cold weather in Massachusetts and moved back to sunny New Mexico. I took the NM Bar Exam that summer and was admitted to the New Mexico bar in September 2010.. In December 2011, I decided to become a prosecutor for the Third Judicial District Attorney’s Office, where I worked for about a year and a half. Thanks to my time at the District Attorney’s office, I learned how to handle to fast pace of the legal profession (my caseload comprised of an average of 150 active cases), how to construct a case to overcome a heavy burden of proof, and how to protect a case against the attacks of opposing counsel. While at the District Attorney’s office, I also had the opportunity to be part of the Magistrate Drug Court program, which is dedicated to providing treatment services for repeat DWI offenders. Being part of Drug Court was one of my favorite experiences of being a prosecutor because it allowed me the opportunity to see the law used as a source of rehabilitation and healing.. After several years focusing on primarily criminal matters, I decided to further expand my experience in civil law, so I accepted a position at a local civil firm. During this time I worked to refine my skills in the civil law realm. I handled a wide range of cases from probate of wills to property disputes to divorce and child custody issues.. When I decided to open my own firm, I was determined to my it the goal in every case is to provide my clients with the best possible representation and to obtain the best possible result at the most reasonable price possible. “Seek Justice” is the motto I live by, and I will fight tooth and nail to see justice is done.. If you have a legal matter for which you are seeking effective representation, call the Cardenas Law Firm.. Now accepting cases for:

I was born in Las Cruces, New Mexico.  I went to college in California at Claremont McKenna College.  I went to Law School at Cornell Law School.  I worked for a few years at an excellent large firm in Dallas, Texas.  Ultimately, however, I made the somewhat counter-cultural decision to return home to Las Cruces, New Mexico to work with my father.  We have a very diverse practice that includes work for many of the community banks in the area, work for the City of Las Cruces, and both litigation and transactional assistance for large companies, small businesses, and individuals throughout Southern New Mexico and West Texas.  I have cases in all levels of state court as well as federal court in New Mexico.  I have also retained my license in Texas and always have a few matters going in Texas, mainly El Paso.   There are only a few areas of law in which I do not practice, and I enjoy the challenge of working on something new every day.  I also enjoy being able to help people in the community resolve their legal problems in as efficient and affordable way as possible.

Firm: The Lahann Law Firm

I started The Lahann Law Firm on January 1, 2007, with a mission of being the best criminal defense attorney in Southern New Mexico. I’ve enjoyed a great deal of success as a criminal defense attorney and nothing thrills me more than winning legal battles on behalf of my clients. I can’t win every case, but I think my clients know that I’ve done everything I can to help them through the most difficult time in their lives.. Most of my clients come to me because they have been referred to me by former clients, or by police officers and prosecutors. I’m proud of my reputation and I work hard to keep it up. I was both humbled and honored recently when I was notified by the Las Cruces Sun-News that I had won their Readers’ Choice Award for “Best Attorney” in Las Cruces for 2012. It is a terrific honor but I don’t see it as “mission-accomplished.” There’s still a lot of work to be done helping good people fight their criminal charges; I think my best days are still ahead of me.

I have been an attorney since 2003.  My practice areas include Criminal Defense, Personal Injury, Civil Rights, and a general civil practice.. I am best known for my high profile defense of MMA Fighter Joe Torrez when he was the victim of a violent home invasion on January 1, 2014.  Mr. Torrez came under scrutiny after one of the perpetrators died during the home invasion.  I was successful in preventing the State of New Mexico from charging Mr. Torrez.  This case made international headlines.  I have been involved in many other high profile cases, including the Columbus Gun Smuggling case and the Reese family gun case.. I have been a member of the Criminal Justice Act panel for the United States District Court of New Mexico since 2010 and have handled over 1,200 cases in federal court.  When one considers the hundreds of cases I have defended in New Mexico state courts, it is hard to find an attorney that has as much experience in this state when it comes to criminal defense.. I have tried more than 50 cases at that federal, state and local court level and I win most of my trials or at least obtain a better result than what had been offered by the prosecution before trial.. I represented the Las Cruces Sun News and New Mexico In Depth, two major New Mexico media organizations, to enforce a public records lawsuit involving an audit of New Mexico's mental health care system.. In addition to my criminal defense work, I practice personal injury, representing victims of negligence in car, truck and motorcycle accidents.  I have represented victims of vicious dog bites.  I have represented victims of bad police officers who abused their power and authority.. When you hire me, your problems become my problems.  Prior to becoming an attorney, I served in the United States Marine Corps as an infantryman and I carry the values I learned as a Marine with me today.  That means I do not give up and, most importantly, I do not like to lose.

Estate Planning:. Does the idea of preparing your will put you off?  Many people believe it is something only old rich people must do.  Don't believe it!  Estate planning is a process to get your affairs in order so you will make life easier for your surviving family members when you die.  Estate planning is something you do for your family.    An estate plan is about your family not money!  It can help maintain healthy family relationships during a tense and traumatic time.. It is never too early to plan with a simple last will and testament, advance health directives and durable power of attorney.  We hear about or maybe you know someone who suffered a fatal heart attack, stroke or was involved in a car accident.  Events like this do no leave time for you to plan for your family.  It is better to have estate planning documents in place before they are needed and before it is too late to make them.  Remember that estate planning is not just for what happens to your assets after you die.  You need protection in case you suffer incapacity or the inability to speak or act for yourself.  Having a durable power of attorney for health care and to manage your assets right away can prevent a situation that creates work and hassle for everyone during an extremely difficult and emotionally demanding time.  Estate planning covers you in your lifetime and death.. It doesn't have to be difficult, expensive or depressing.  For the vast majority of people there is no need to worry about estate taxes or fancy trusts.  It takes only a few steps:  looking at what you own, have a simple will or trust made to take care of your family and loved ones and reviewing your beneficiary designations on other accounts.. Do you already have a will and other estate planning documents?  How old are they?  What life events have occurred since they were prepared?  Have your estate planning documents reviewed after a divorce in the family, after a death, after the birth of children or grandchildren, if there is there a remarriage with a second family involved.  There are many other reasons to have your estate planning documents updated.. My goal with estate planning is to ensure that my clients set up a plan that will accomplish their goals should the unexpected happen. It is just as important that the clients understand the plan they have in place. Every family is different and so every client must be approached differently. My goal with probate is to ensure the process happens as efficiently as possible, but also to make the process as painless as it can be.. Call and make an appointment today!
