The focus of my law practice is helping people who were injured. Over the past decade, I have helpe people who are either injured at work or due to the negligence of others 1) know their rights, 2) make informed decisions, and 3) obtain whatever benefits they are entitled to and wish to pursue.
Success in trial courts and appellate courts, by trial and by written brief mark my career as do so some landmark properties and written reported decisions of the Rhode Island Suprme Court. I am a widely experienced sole practioner, a downtown firm lawyer originally.. Some examples of things I've done that really meant a great deal to the client.. There's the individual who had his third breathalyzer refusal and then while I had just won an appeal on his third, got his fourth breathalyzer refusal charge, and was faced with a loss of license for five years and perhaps indefinetly. I won the trial on the fourth and won the appeal on the third and got it dismissed at trial. My client never had another problem, proving that justice was served.. There's an Aubon Pain on the East Side for more than twenty two years now, because I handled a controversy Au Bon Pain has really anchored that portion of the street and it seems the street was the better for it.. There are persons who faced a criminal sentence that did not receive a sentence because of how I handled their case. There are people who were told an accident was their fault by a consensus of all other persons, but I still recovered damages for them. There are peoeple who were unfairly targeted by their employer and fired, but who were compensated with more than a severance. There's a machine manufacturer whose designer will be more careful where he puts the valve next time and an injured worker paid was paid not only workers compensation but a settlement with the machine manufacturer.. I've handled matters for an important utitlity and a municipapltity too. There are rate payers for a utiltity who didn't absorb the costs of costly installations because, as part of a team, we showed they weren't necessary.. There's a clients whose property couldn't sell for a year at $350,000 so I marketed it differently, drew up the contracts the deal required and sold it for $499,. The lender concurred in my valuation.. There was the student with top grades and approving teachers, yet the City Superintendant and his big downtown law firm thought they were going to suspend my client from school indefinitly because of one provoked remark defending himself from a bully. A letter stopped their "politically correct" harasment and the boy went back to school where his teachers had always described him as a pleasure ot have in class.. There was a disabled woman , a special needs trust beneficiary who needed someone to get involved and de-escalate tensions that woud have wasted her trust resources on litigation costs.. I've never been afraid of the difficult case. I am a natural born contrarian and independent enought to make my own judgment. It simply has to be worth our time and effort, yours and mine and have real merit . It can't ust be about revenge or malice or greed or falsity. If it';s that, i don;t want it. But when you have been wronged and hurt by it, or are accused and at the mercy of others, I will stand by you.. I grew up in Cranston, Rhode Island, sort of the youngest of six kids, as my twin was ten minutes older than me. I worked my way through college, (Univerity of RI '84) was proud to graduate in four years right on time, to be commissioned as in officer in the Field Artillery. I went on to law school after some military education and again, sold furntiure, clerked in a law firm and served in the National Guard as I attended and graduated in three years. I returned to RI and started clerking in a downtown firm where my writing sample from law school demonstrated training and ability in obtaining " Summary Judgment" a great way to win a case on the law when the facts are not genuinely in dispute. I put that right to work and thus got to the Rhode Island Supreme Court very early in my career. Student loans dogged my lifestyle and high taxes on a single man with no dependents left me needing to keep more of what I earned, so I became a home office professional in my own practice on January 1, 1993. .. Solo practice led me into criminal law and I became a federal defender on the Rhode Island panel and served on same until they opened a staffed defender office, at which time I had begun serving as an assistant counsel to the Chief legal Counsel for the Providence Water Supply Board where I handled everything other than Public Utitlity rate cases. This involved me in administative enforcement actions and also lots of municipally related litigation. I've also successfully handled product liability and wrongful death. The litigation and courtroom skills I began in an excellent second year course taught by a former Justice Department Litigator, and honed as a law clerk at a Sprinfield Law firm and mastered in a downtown Providence defense firm have been ciritical to my clients. As part of a firm, I have representing clients such as Stop and Shop and St Joseph Hospital and all mannert of cleints who bought an insurance policy and found them selves being sued. I pride myslef on strong persuasive legal writing skills, strong insight and analysis skills, good fact finding skills and a steady articulate resolve in any courtroom.
Since 1991 my law office, The Law Offices of Kevin P. Landry, P.C. have been helping citizens of Massachusetts and Rhode Island recover following an accident or injury. In the past 22 years our offices have helped settle over 1,000 cases, with our lead attorney Kevin P. Landry still personally in contact with each of his clients. After graduating from the New England School of Law in Boston, I went on to secure a Master’s Degree in Law and was admitted to the Massachusetts, Rhode Island and New York bars.Since the beginning I knew I wanted to establish my own law practice. I did not want to be handed a case the moment before a trial. Instead I wanted to work on my cases from the start, and get to know my clients and research their cases from the very first day.I fully understand that the majority of my clients have suffered a traumatic injury, illness or accident. Early in my career I realized that victims of such incidents needed to have the ability to immediately speak with me and not a receptionist or secretary, in order for me to help to fully understand and protect their legal rights.I make myself immediately available because big insurance companies and even defendants are looking to take advantage of victims without legal representation. Always talk to a lawyer before you talk to your insurance company.
Simone & McCahey LLP has one goal: Getting you the best results possible.. We believe in good communication. Call today to speak to an attorney, and not a staff member. You will have direct access to your attorneys, and we always return calls!

I have been practicing law for more than 20 years in Massachusetts and Rhode Island state and federal courts. In my practice, I have represented men and women in a wide range of disputes including family law (divorce, custody, visitation, child support), employment law (discrimination and harassment), personal injury, wrongful death, business disputes, land disputes, and unfair and deceptive trade practices. I have taken cases through negotiated settlements, mediated settlements, arbitration awards and trial conclusion, both jury and judge.. My focus is on the needs and interests of the individual client: Individual attention for the individual's needs. The legal path utilized is different for each case and the needs and interests of each individual or business. I, with my experience and knowledge, try to bring each case to a resolution that makes sense for the clients interests as a whole. With my focus on the particular needs of the client, communication is of the highest priority. I attend to all client contact personally and maintain as best as can be achieved a policy of return contact with clients within 24 hours if not the same day.. Having practiced in the varied areas listed above for more than two decades, I have seen the effect that exposure to the court system can have on clients, both individual and business. The conflict that is a part of modern litigation has a negative impact on most individuals and entities involved in the process. This effect varies depending on the issues and interests that the parties are attempting to resolve. Over the years, I have trended toward a collaborative application of the litigation model that is the standard format in our court systems. Negotiation and alternative dispute resolution are invaluable in attempting to preserve relationships and non-economic interests that are stressed by litigation. The blending of the litigation tools with a collaborative approach allows for tailoring the process of each case to the specific needs of each client.. Having seen the benefits of mediation from a party's perspective, I have received my certification as a mediator and am employing the abilities and principles that I have developed as a litigator from a different perspective to assist parties to reach a unified resolution. My goal in mediation is to allow the parties to recognize the totality of their interests and communicate these interests with their counterpart to help each party explore options that make sense for each party as well as the joint interests that the parties share. Such a resolution preserves the relationship that the parties have and facilitates the communication necessary to allow the parties to move forward in resolving their dispute. Joint resolutions through this process afford the parties a greater control of their interests, a greater investment in compliance with the resolution and a framework to employ in future conflicts.

Hi. I’m Mark Fay. I’m a partner with the law firm Murphy and Fay. I have been a partner here for the last 14 years. I have been a practicing attorney for 25 years, all in civil litigation, all in trial work, all in either representing or defending individuals and personal injury cases. One of the benefits that I have in my trial background is that from my first 11 years of practice, I represented insurance companies. I was representing the defendants. I was the person that was helping the insurance companies to determine which cases will not go to a trial, which ones going to a trial, who’s gonna get how much money and how soon. I know how the defense side works, believe me because I was in it for 11 years. For the last 14 years, I’ve done all plaintiff’s work which means now I’m representing all the individuals that were injured. The insurance companies know me. They know I can try cases. They know I can evaluate cases and they know if they decide to go up against me in a trial, that I’m gonna do a good job. How does this help you? This helps you because part of the evaluation any insurance company makes in regarding how much they’re gonna pay on a case is whether or not the attorney is gonna do a good job at trial. I know because I made that decision for 11 years. If a plaintiff’s attorney can do a good job at trial, the insurance companies are more likely to pay you the maximum amount of settlement as possible to avoid a worst result during trial. If they know the plaintiff’s attorney has no trial experience or little trial experience or is not willing to go to trial, if the case is worth 50 then they’ll offer him 25. If it’s worth a hundred, then they’ll offer him 50. That’s a very important component. I have that. I have that trial experience. I have the insurance defense background. I can help you.
