After my arguments in Kanji v. State, 4 So.3d 65 (5th DCA 2009), the 5th District Court of Appeal ruled that although a Judge has "sole discretion" to deny the sealing or expunging a criminal record, it is not unfettered discretion and he or she may not arbitrarily deny a sealing or expunction. While exercising his or her discretion, the Judge must consider all the facts and circumstances and may not deny the petition based solely on the nature of the crime..
