California, withhold final paycheck

employment attorney California Aug 10, 2026
Location: California. I emailed my resignation to my boss, 2 weeks in advance. I only work 1 day a week, boss asked me to stay for 2 more weeks, which I agreed, but he eventually called and told me he no longer needed me, on my last day of work. Next day, I emailed my boss and HR regarding last paycheck, telling them I want the payment issue that day, mentioned California labor law (they have been behind on paying me for months). HR texted me, saying they just paid me 2 weeks, and final paycheck will be on Friday (total of 4 weeks). It has been 2 weeks from my last work day, more than a week from the promised Friday. I don’t want to keep telling them on how to do their job. I want to file complaint as I think whatever they are doing, should be corrected/punished. If I file, would it take a long time for me to get paid? Thank you!
