Location: Illinois We were sued by our hoa for a late assessment. We settled the day of court with their lawyer for a lesser amount that their lawyer offered and wrote up. The order stated the motion was dismissed with prejudice and the amount tendered was deemed paid in full up to the court date (July 21). Since then the management company cashed our check but instead of following the order, they simply treated it like a regular tendered payment and simply subtracted it from the other balance. On top of that they added a late fee and a legal chargeback dated post dismissed order. Whenever we contact the property manager she simply states the "board received the order and is reviewing it" and "once the board decides on a resolution we will be contacted." It is now one month since the order was put in place and we have an outstanding balance with extra fees as well as being denied access to amenities and some aspects of our homeowner portal. If we file a motion for enforcement, they most likely will still not comply because they have no consequences. How do we protect our home? We paid for our mistake already but we fear they will come after our home again if we do not pay their made up fees.
