Transferring sublease
landlord tenant attorney New York Aug 23, 2026
Hello, Location: Upstate New York I signed a sublease but had a change of plans. I found a potential sub-sub tenant willing to take over my lease. My original lease was $1600 and was looking to transfer my same lease to the incoming subtenant. However, the full rent is $2000, which the differences was subsidized by the main tenant. The main tenant is subsidizing $400 of the rent. When the main tenant found out I was trying to assign my sublease, she stated I have no rights to negotiate the sub-sub lease contract and that she wanted the incoming subtenant to pay $1800 instead of $1600 as I was paying. Does she have the rights to have the sublease contract renegotiated if my sublease contract states $1600 and I am passing on my contract to the incoming subtenant. I know that all parties have to agree on the qualified candidate but assuming they are qualified, can she reject the incoming subtenant and demand more money than what’s on my current sublease contract? Please advise. Thank you!
