Can I sue my gyno?
Medical Malpractice Delaware Aug 26, 2026
Location: Delaware I visited a gyno for my early pregnancy. At six weeks she told me my next visit we’ll do a blood test for chromosomes+gender result. At eight weeks, she told me to do another urine test since the last one was inconclusive. She also said there would be no blood today test but rather it will be at the next visit. I became anxious. I returned at 10 weeks, found there was no fetal heartbeat and the urine collected never got tested. Gyno pushed for a D&C instead of medicine to expel the miscarriage. The miscarriage itself was a shock so I requested that she take a sample of the fetus to see what had gone wrong. During my D&C, I was told the sample of my fetus was taken and sent to a lab for results. My recovery was slow, and I started having issues with holding urine & I told this to her during my follow up. She told me it should just solve itself. The next day, the lab report comes and tells me that the sample contained MY TISSUE, not the fetus’s tissue. Can I sue her for this? It is scary to think she couldn’t identify what she took out of me during the surgery.
