Small Claims Court: Sue Landlord or the Business

landlord tenant attorney Texas Jul 25, 2026
Location: Texas Hello everybody! Have a small claims lawsuit we want to bring forward against our landlord regarding negligence of repairs that led to toxic black mold which required us to vacate the premises. We incurred a number of expenses that we will be seeking compensation for. My question: On the lawsuit, should we be suing our landlord, “John Doe”, or the company he created for purposes of renting “Company Name LLC”. Our lease has “Company Name LLC”. But the place for signatures has his actual name “John Doe”. Additionally, if we do sue the business, the court clerk told us we would need to identify the registered agent of the business? How do we go about finding that in Texas? Thank you all so much in advance! I can provide any additional info in comments.
