Vehicle title issue, deceased parent.

North Carolina Jul 21, 2026
Location: North Carolina, Onslow County I recently got into an accident, rear ended, car totalled, big bummer. What makes things difficult is the title of the vehicle. It has me and my mother's name on it since it was a both of us kinda car. I drove otr and she wanted something nicer. She passed away in 2023, paid off the car in 2025, for some reason the lien swapped banks and I had to pay a fee to get the title. I of course forgot and never intended on getting rid of the vehicle so it didn't matter. Well now I'm in this situation and have no idea what to do. I am unsure of what needs to get done since statefarm won't take the title with her name on it. The license plate agency says I need a letter of testamentary, the DMV says I need to be executor of her estate. The clerk of court says I need to fill out a small estate affidavit. They are running me in circles for a car that is totalled. She had one vehicle in her name only and the other in both of ours. One is totalled and the other is worth less than a thousand bucks. That is all that she had in her name, other than some medical bills I'm sure. Any tips or assistance is greatly appreciated.
