My practice is limited to business and commercial litigation and trial. I do not draft contracts, offer advice on company formation or otherwise have a transactional practice. It's just litigation and trial.. Most of my cases are focused on business and commercial litigation and trial on behalf of small businesses where the damages at issue are more than $100,000. My strategy is to push the case to a resolution through settlement or trial efficiently, effectively, and ethically. Most cases that resolve favorably are the ones where the party is prepared to go to trial so my focus is on litigating the case with that end in mind. I usually represent clients for an agreed hourly or flat fee rate. While I accept some business and commercial cases on a hybrid and contingency basis, the damages must be significant and the defendant has to have assets to satisfy a settlement or judgment.. I do offer some litigation representation on a flat fixed fee including drafting demand letters and resolution of disputes without a lawsuit. I will also pursue lawsuits with damages of less than $100,000 for an agreed flat fee (although it usually needs to be at least $30,000 in damages to make economic sense).. I genuinely enjoy practicing law and the more complicated and convoluted the legal problem or the case, the more I really enjoy figuring out a strategy and a solution. However, I understand that clients aren’t quite as enamored about the legal challenges they may be facing. My goal when I work with clients is to clarify and simplify the legal issues, offer the best ways to achieve a favorable result and actually make a recommendation on how I think we should proceed. I think it’s also important to understand the limitations of litigation and when a lawsuit might not be the best option. However, if we do need to file a lawsuit, I’ve handled hundreds of litigation cases over the years including complex business disputes, multi-million dollar shareholder and breach of contract litigation and other business and commercial litigation. I have the experience to navigate a case through discovery, settlement, trial and an appeal if necessary..
