I am a hands-on appellate attorney who enjoys strategizing appeals, crafting high-impact legal briefs, and interacting with appellate judges at oral arguments. My primary focus is federal issues litigation - for example, defending companies in high-stakes damages suits involving federally regulated or procured products or services, and representing industry associations as parties or amici curiae in appeals challenging federal regulatory actions. My substantive areas of expertise include federal preemption of state and local law; pretrial defenses based on lack of justiciability and/or subject-matter jurisdiction; class-action fairness issues; and all aspects of pesticide litigation and regulation. I have authored hundreds of briefs, petitions, and motions on complex legal issues for parties and amici curiae in the U.S. Supreme Court, in every federal circuit court of appeals, in state appellate courts, and in federal and state trial courts. I have presented oral arguments before eight federal circuits (Second, Third, Fourth, Fifth, Seventh, Ninth, Eleventh, and D.C.), before three state supreme courts (California, Texas, and Wisconsin), and in federal district courts throughout the United States.
