Both parties sign an agreement in advance committing themselves to the Collaborative process and agreeing, as a form of “insurance,” that they must end their attorney’s representation and find new counsel if the Collaborative process were to break down and move to litigation. This team then works intensely outside of the court system through a series of carefully planned and well-organized meetings to assist the spouses in finding their best possible resolution to their divorce or post-divorce matter. While these cases are not always easy, this process allows the spouses to work through some of their pain and frustrations within the safety of the team while still working creatively and cooperatively to solve the practical and legal problems created by the divorce. Often these Collaborative cases result in the spouses ending their marriage, after a lot of hard work, while maintaining a tone of respect, dignity, and civility with one another that is difficult to achieve in a typical litigation case..
