Location: Montana Hi Reddit. I’m seeking advice regarding employment laws and HIPAA violation. I’ve worked for an AAAHC private practice for about a year and a half. My role is Treatment Coordinator but it’s within my scope to take payments from patients and send out statements which gives me access to patient charts and ledgers. I became aware that the practice was not paying patients back their overpayments once their insurance finalized when my coworker brought it my attention. She had been instructed to find all the patients whose accounts had been audited by our biller so that we could recoup that money. In doing so, she found over 500 patients that had credits on their account, ranging from $50-$10,000 with a note from our biller “credit is valid and due.” These are mostly from 2020-2026 but some date as far back as 2010. Some of these patients are Medicaid patients. Our financial policy that every patient signs states “If there is a credit on your account after insurance is settled, refunds can be initialed per patients request or the account will be audited within 6-12 months after the account settles. Checks will be issued after the account has been audited for accuracy in either case.” My coworker made a spreadsheet of all credits that were due and it totaled around $350,000. She brought it to the manager, our biller, and the doctor so that they could correct this mistake. They brushed it off and 11 months later, she gave…
