I’m looking for advice about whether I may have any legal recourse against a Kia dealership or Kia America after an engine replacement. I have a 2016 Kia Optima 2.4L with approximately 161,000 miles. I bought the car new. The original engine developed a P1326-related failure. I brought the vehicle to a Kia dealership, and Kia approved an engine replacement. The dealership replaced the engine. Before returning the car to me, they contacted me recommending several additional services, including drive belts, transmission fluid service, brake fluid flush, fuel injection service, tires/alignment, and a driver-side axle. I declined those services. The catalytic converter/exhaust system was not included in those recommendations, and I was not warned that there was an exhaust restriction or that the catalytic converter needed replacement before I drove the vehicle. The dealership then told me the vehicle was completed and ready for pickup. I picked it up and drove only a few minutes before the check-engine light came on. I pulled into a nearby Walmart parking lot, turned the vehicle off, and it would not restart. It had to be towed back to the Kia dealership. I have an original video that I took immediately after the vehicle became disabled showing the odometer at 161,629 miles. After the vehicle was returned, the dealership diagnosed a clogged catalytic converter/exhaust manifold catalytic converter. Their written diagnostic states that the technician found rich-condition codes and an obstructed exhaust/intake and, upon inspection, found a clogged manifold catalytic converter. Location: Oregon, USA. Once upon a time not long ago I (25F) loved my job bartending at a cute taphouse. Then the boss (55+M) showed his true colors and got really creepy. First it was him brushing up against me in tight walkways and calling me “good girl” frequently. Next, it was a new employee confiding in me that he had said things about how he wanted to slow dance with her and how she was the most beautiful woman ever. Then it was me experiencing harassment via texts on my days off. Location: Oregon I, like several thousand in student loan repayment under Mohela, had incorrest interest added to my account several times through the life of my 2 consolidated loans. I am currently in the now-cancelled SAVE program and would like to switch to a standard repayment plan, but am afraid that by doing so, I would be switched to a different servicer and would be carrying the incorrect excess interest while I continue to recover said overcharges with Mohela. My bottom line question is: would it be in my benefit to pursue recovery of these over charges (after I'm presumably switched to a different servicer) via small claims court or stay with them until the the deadline to switch to another repayment plan while I pursue every avenue of recovering said overcharges? Due to Mohela issuing only two statements since 2023, I've had to track my payment and balance via spreadsheet and catching errors when checking/screen printing my account balance monthly. Location: OR Can an Oregon landlord legally carry one tenant's security deposit over to a new lease with a different tenant without the original tenant agreeing to it? Does the fact that my partner continuously occupied the apartment mean my tenancy never legally terminated when I gave notice and moved out? If the new lease replaced my tenancy, when should the landlord have returned/accounted for my deposit? Would ORS 90.300's 31-day requirement or statutory damages potentially apply? The apartment is in Portland, if the additional Portland tenant protections make a difference. Last year my parked and empty car was hit and the driver fled the scene without leaving his contact info. My dashcam clearly picked up the driver's face and license plate as he got into his truck, backed into my car, and drove off. I filed a police report and the police told me that in Oregon they don't offer license plate owner lookup results to the public, and that I need to go through my insurance and they will handle the lookup. So I filed a claim with State Farm and had my vehicle fixed (paying the $1k deductible). State Farm subcontracted subrogation of the claim to Wilber Group, and said I'd get my deductible refunded once the at-fault party paid up. A year went by, and I got a letter from State Farm saying that they're giving up on subrogation, and if I want my deductible back I'll need to sue the at-fault party. The letter did not however give me any info about the at-fault party. I contacted Wilber Group and asked for the name/address of the at-fault party so I could file a small-claims suit to recover my deductible, and Wilber Group told me their policy does not allow them to give out that information. I contacted State Farm and they told me the same thing, advising me to contact the Oregon DMV with the plate number. The Oregon DMV is not returning my emails.
