I am board certified in Criminal Law by the Texas Board of Legal Speciliazation. . That means I'm one of very few attorneys who can say "I specialize in criminal law." My practice is primarily state and federal criminal law and appeals.. I grew up in the small southern Arizona border city of Douglas, Arizona. I joined the U.S. Army and served in as a U.S. Army Ranger in the 2nd Battalion, 75th Ranger Regiment at Fort Lewis, Washington and then with the 160th Special Operations Aviation Regiment (SOAR) at Fort Campbell Kentucky.. After the military, I went to law school and started out doing plaintiff's legal malpractice, suing other attorneys/ lawyers who had committed some form of fraud or breached a fiduciary duty to their clients. While with that firm, I second chaired two million dollar plus cases, one of which took over 5 weeks to try.. I subsequently moved to El Paso, Texas where I was an Assistant District Attorney and served in the office's "Family Violence Unit," where I tried over 20 domestic violence or Assault Causes Bodily Injury (AFV) trials to a jury.. As of June 1, 2010, I opened the Benjamin Law Firm and handle state and federal criminal, civil and appeal cases, and I am going to use my experience to benefit you, my next client.

I have been practicing law since 1981, having started at Vinson & Elkins right out of law school at the University of Texas. I am a very active trial lawyer, having tried over 350 cases to jury verdict, a number that real trial lawyers would recognize as meaningful. I'm married to Colleen Cullen Akers, the daughter of a legendary trial lawyer, Dick Cullen. I have three wonderful children, one of whom is a criminal defense lawyer who is already becoming well regarded among his peers. We spend a great deal of our spare time with church and charitable activities through various groups, but mostly through the Order of Malta, a holy order of the Catholic Church in which I am a Knight.

I believe in treating my clients as intelligent equals in a joint venture to solve their problems and improve their lives. This means telling you what you need to know, not what I think you want to hear. It also means explaining law and procedure to you without talking down to you.. I believe in providing more value to my clients than they expect or request. This starts with being accessible and responsive to client needs. It goes beyond diligent preparation and prompt delivery of services. It is the result of taking a real human interest in my clients.. I believe the best lawyers genuinely delight in solving their clients problems and in helping their clients achieve their goals.. I grew up in Houston and obtained my undergraduate degree from Texas A&M University, where I majored in political science. I graduated with honors from the Valparaiso University School of Law in 1999. While in law school, I was privileged to clerk at Harper & Rogers, P.C., a premier criminal defense firm in Northwest Indiana. I settled in Austin after law school and worked for a small firm for two years before launching my own practice at the end of 2001.. I am board certified as a specialist in Criminal Law by the Texas Board of Legal Specialization.. Since 1999, I’ve maintained membership in the National Association of Criminal Defense Lawyers, the Texas Criminal Defense Lawyers Association, and the Austin Criminal Defense Lawyers Association. I am also a member of the Austin and Williamson County Bar Associations.. In addition to my law license, which allows me to practice in all state courts in Texas, I am also admitted to practice in the Federal Courts in the Western District of Texas, the United States Court of Appeals for the Fifth Circuit, and the United States Supreme Court.

Having recently relocated from FL to San Antonio, TX I am enjoying getting to know the area through offering community education to families about their legal life planning needs.. I work with families to help them protect everyone and everything they love by enabling them to confidently design legal plans that will make sure their loved ones are taken care of how THEY want. Plans we design also ensure that their assets are handled how THEY want, leaving as little (or nothing!) to the state's discretion as possible when something happens to them.. I enjoy working through the hard questions with people so that afterwards they walk with a thorough understanding and, more importantly, total peace of mind. So, I ask.. Do YOU know what would happen to your children and money if something happened to you TODAY?. Visit this website to begin the process of naming guardians for your children for FREE, with NO STRINGS attached. This is an important step I want everyone to take now.
