A finding against an insured was improper where, in order to take a personal injury protection reimbursement, the insurer was required to pay a pro rata share of the legal expenses incurred by the insured to arbitrate the uninsured motorist claim.. A landowner has an affirmative duty to maintain common areas in a reasonably safe condition. The Court held a Plaintiff may prevail on her negligence claim by showing either actual or constructive notice of the unsafe condition or that the unsafe condition was reasonably foreseeable.
