Aggravated penalties for certain violations involving a person under 21 years of age and committed by a sex offender or child kidnapper.
Official statutory text
(a) Notwithstanding AS 04.16.051 , 04.16.055, 04.16.057, and 04.16.180, the penalty for a violation of AS 04.16.051 , 04.16.055, or 04.16.057 that involved a person under 21 years of age and that was committed by a person who is required to register as a sex offender or child kidnapper under AS 12.63 is as follows: (1) if the underlying offense is a violation, a sex offender or child kidnapper committing the offense is guilty of a class B misdemeanor and shall be punished as provided in AS 12.55 ;
(2) if the underlying offense is a class A misdemeanor, a sex offender or child kidnapper committing the offense is guilty of a class C felony and shall be punished as provided in AS 12.55 ;
(3) if the underlying offense is a class C felony, a sex offender or child kidnapper committing the offense is guilty of a class B felony and shall be punished as provided in AS 12.55 .
(b) In this section, sex offender or child kidnapper has the meaning given in AS 12.63.100 .
(2) if the underlying offense is a class A misdemeanor, a sex offender or child kidnapper committing the offense is guilty of a class C felony and shall be punished as provided in AS 12.55 ;
(3) if the underlying offense is a class C felony, a sex offender or child kidnapper committing the offense is guilty of a class B felony and shall be punished as provided in AS 12.55 .
(b) In this section, sex offender or child kidnapper has the meaning given in AS 12.63.100 .
