Charter school, SDA district, construction of facility with public funds other than federal.

35. Notwithstanding the provisions of section 10 of P.L.1995, c.426 (C.18A:36A-10) or any other law, rule, or regulation to the contrary, a charter school located in an SDA district may construct a facility with public funds other than federal funds, including loan funds received pursuant to the provisions of sections 30 through 34 of P.L.2023, c.311 (C.34:1B-21.37 through 34:1B-21.41), and be subject to the provisions of the "Public School Contracts Law," N.J.S.18A:18A-1 et seq., provided that the public funds are provided for a school facilities project approved pursuant to section 32 of P.L.2023, c.311 (C.34:1B-21.39).
