§ 1-103. Definitions. As used in this chapter, unless a different\nmeaning clearly appears from the context or unless a different meaning\nis stated in a definition applicable to only a portion of this chapter:\n 1. "Agency" shall mean any state department, agency, board, public\nbenefit corporation, public authority or commission.\n 2. "Office" as used in sections 5-108, 5-111, 5-113, and 5-117 of\narticle five and articles six, seven, eight and ten of this chapter\nshall mean the New York state energy research and development authority\nestablished pursuant to article eight of the public authorities law.\n 3. "Coal" shall include bituminuous coal, anthracite coal, and\nlignite.\n 4. "Commissioner" as used in sections 5-108, 5-111, 5-113, and 5-117\nof article five and articles six, seven, eight and ten of this chapter\nshall mean the president of the New York state energy research and\ndevelopment authority.\n 5. "Energy" means work or heat that is, or may be, produced from any\nfuel or source whatsoever.\n 6. "Energy resources" shall mean any force or material which yields or\nhas the potential to yield energy, including but not limited to\nelectrical, fossil, geothermal, wind, hydro, solid waste, tidal, wood,\nsolar and nuclear sources.\n 7. "Fossil fuel" shall mean coal, petroleum products and fuel gases.\n 8. "Fuel gases" shall include but not be limited to methane, natural\ngas, liquefied natural gas, and manufactured fuel gases.\n 9. "Municipality" or "municipal corporation" shall mean a city,\ncounty, town, village, school district, special purpose district, or an\nagency thereof.\n 10. "Person" shall mean any individual, trustee, agency, partnership,\nassociation, corporation, company, municipality, political subdivision\nor other legal entity.\n 11. "Petroleum products" shall include all products refined or\nrerefined from synthetic or crude oil or oil extracted from other\nsources, including natural gas liquids.\n 12. "Renewable energy resources" shall include sources which are\ncapable of being continuously restored by natural or other means or are\nso large as to be useable for centuries without significant depletion\nand include but are not limited to solar, wind, plant and forest\nproducts, wastes, tidal, hydro, geothermal, deuterium, and hydrogen.\n 13. "Telecommuting" shall mean the conservation of energy through the\nreduction of travel by employees of the office to and from their\ndesignated workplace through the use of telecommunication and computer\ntechnology in tasks including, but not limited to, information transfer\nand processing.\n 14. "Critical energy infrastructure" means systems, including\nindustrial control systems, assets, places or things, whether physical\nor virtual, so vital to the state that the disruption, incapacitation or\ndestruction of such systems, including industrial control systems,\nassets, places or things could jeopardize the health, safety, welfare,\nenergy distribution, transmission, reliability, or security of the\nstate, its residents or its economy.\n 15. "Industrial control systems" means an information system used to\nmonitor and/or control industrial processes, including supervisory\ncontrol and data acquisition systems used to monitor and/or control\ngeographically dispersed assets, distributed control systems,\nhuman-machine interfaces, and programmable logic controllers that\ncontrol localized processes.\n
