§ 846-e. Periodic review of contract performance; renegotiation and\ntermination of contract. The division shall, by regulation hereinafter\npromulgated, provide for the review, at periodic intervals, which shall\nas far as possible be coincidental with payment periods, of the\nperformance of companies under their respective contracts with the\ncommissioner. Such reviews shall, among other things, be for the\npurposes of ascertaining the quality and quantity of the company\nactivities performed, the conformity thereof to contract provisions and\nthe financial integrity and efficiency of the company. Contracts may be\nterminated by the commissioner upon a finding of substantial\nnon-performance or other breach by the company, and contracts shall be\nmodified and renegotiated, from time to time, in light of the actual\nperformance, new or changed conditions, or otherwise.\n
