Payment of supplemental retirement allowances of retired police officers and firefighters of certain cities

§ 207-ii. Payment of supplemental retirement allowances of retired\npolice officers and firefighters of certain cities. 1. Notwithstanding\nany other provision of law to the contrary, payment of all supplemental\nretirement allowances which, for the month of July, nineteen hundred\neighty or any subsequent month preceding the month in which the date of\nenactment of this section occurs, were payable pursuant to section two\nhundred seven-i of this chapter, as added by chapter five hundred\nsixty-one of the laws of nineteen hundred sixty-seven, to any pensioner\nof a pension or retirement system of a paid police department of a city\nhaving a population of one million or more whose employment in such\ndepartment began on or after March twenty-ninth, nineteen hundred forty,\nshall be deemed to have been the obligation of the pension reserve fund\nof such pension or retirement system and payment of any such\nsupplemental retirement allowances to any such pensioners for any\nsubsequent month shall be the obligation of such pension reserve fund.\n (2) Notwithstanding any other provision of law to the contrary, if a\npension reserve fund shall be established by law for a pension or\nretirement system of a paid fire department of a city having a\npopulation of one million or more, the funds of which pension or\nretirement system did not, prior to July first, nineteen hundred eighty,\ninclude a pension reserve fund, payment of all supplemental retirement\nallowances which, for the month of July, nineteen hundred eighty or any\nsubsequent month preceding the month in which the date of enactment of\nthis section occurs, were payable pursuant to section two hundred\nseven-i of this chapter, as added by chapter five hundred forty-six of\nthe laws of nineteen hundred sixty-seven, to any pensioner who retired\nas a member of such pension or retirement system wherein a pension\nreserve fund is established, and whose employment in such fire\ndepartment began on or after March twenty-ninth, nineteen hundred forty,\nshall be deemed to have been the obligation of the pension reserve fund\nand such pension or retirement system and payment of such supplemental\nretirement allowances to any such pensioners for any subsequent month\nshall be the obligation of such pension reserve fund.\n (3) With respect to payments of any such supplemental retirement\nallowances which are referred to in subdivisions one and two of this\nsection and which were made for the month of July, nineteen hundred\neighty or any subsequent month preceding the month in which the date of\nenactment of this section occurs, the actuary of any such pension or\nretirement system referred to in such subdivisions shall determine the\nadjustments, if any, which, by reason of any such payments, the\napplicable provisions of such subdivisions require to be made between\nthe funds of the pension reserve fund of such pension or retirement\nsystem and the funds of the supplemental pension fund of the city\nwherein such system functions, and any such adjustments so determined\nshall be carried out by resolution of the board of trustees of such\npension or retirement system and executive order of the mayor or other\nchief executive officer of such city.\n (4) Notwithstanding any other provision of law to the contrary, all\npayments of additional supplemental retirement allowances pursuant to\nsection thirty or section thirty-one of chapter six hundred fifty-eight\nof the laws of nineteen hundred eighty-four to any pensioner of a\npension or retirement system of a paid police department of a city\nhaving a population of one million or more whose employment in such\ndepartment began on or after March twenty-ninth, nineteen hundred forty,\nshall be the obligation of the pension reserve fund of such pension or\nretirement system.\n (5) Notwithstanding any other provision of law to the contrary, all\npayments of additional supplemental retirement allowances pursuant to\nsection thirty or sect
nhaving a population of one million or more whose employment in such\ndepartment began on or after March twenty-ninth, nineteen hundred forty,\nshall be the obligation of the pension reserve fund of such pension or\nretirement system.\n (5) Notwithstanding any other provision of law to the contrary, all\npayments of additional supplemental retirement allowances pursuant to\nsection thirty or section thirty-one of chapter six hundred fifty-eight\nof the laws of nineteen hundred eighty-four to any pensioner of a\npension or retirement system of a paid fire department of a city having\na population of one million or more whose employment in such department\nbegan on or after March twenty-ninth, nineteen hundred forty, shall be\nthe obligation of the pension reserve fund of such pension or retirement\nsystem.\n
