Regulation and quality control of chemical dependence services

§ 32.01 Regulation and quality control of chemical dependence services.\n This article sets forth provisions enabling the commissioner to\nregulate and assure the consistent high quality of services provided\nwithin the state to persons suffering from chemical abuse or dependence,\ntheir families and significant others, and/or those who are at risk of\nbecoming chemical abusers. The commissioner may adopt and promulgate any\nregulation reasonably necessary to implement and effectively exercise\nthe powers and perform the duties conferred by this article. This\narticle shall govern the operation of programs, provision of services\nand the facilities hereinafter described including those approved under\nthe former article twenty-three and the former sections 31.15, 31.23 and\n31.24 of this chapter, and the commissioner's powers and authority with\nrespect thereto, and shall supersede, as to such matters, sections of\nthe former article twenty-three and article thirty-one of this chapter\nthat are inconsistent with the provisions of this chapter; provided,\nhowever valid certificates of approval and operating certificates\npreviously issued under article twenty-three of this chapter or article\nthirty-one of this title shall remain in full force and effect but shall\nbe subject to conversion upon subsequent review, subject to the\nprovisions of subdivision (b) of section 19.40 of this chapter. Valid\noperating certificates previously issued under section 19.40 of this\nchapter shall remain in full force and effect and shall be deemed to be\noperating certificates issued under this article and will be converted\nto such operating certificates upon subsequent review, subject to the\nprovisions of subdivision (b) of section 19.40 of this chapter. For\npurposes of this article, the term "commissioner" means the commissioner\nof the office of alcoholism and substance abuse services.\n
