§ 1350. Additional regulatory costs. 1. Any remaining costs of the\ncommission necessary to maintain regulatory control over gaming\nfacilities that are not covered by the fees set forth in section one\nthousand three hundred forty-nine of this title; any other fees assessed\nunder this article; or any other designated sources of funding, shall be\nassessed annually on gaming licensees under this article in proportion\nto the number of gaming positions at each gaming facility. Each gaming\nlicensee shall pay the amount assessed against it within thirty days\nafter the date of the notice of assessment from the commission.\n 2. If the fees collected in section one thousand three hundred\nforty-nine of this title exceed the cost required to maintain regulatory\ncontrol, the surplus funds shall be credited in proportional shares\nagainst each gaming licensee's next assessment.\n
