§ 185. Definitions. As used in this article, unless a different\nmeaning clearly appears from the context: a. The term "fund" shall mean\nany public retirement system or pension fund which grants retirement or\npension benefits to employees of the city of New York, employees of the\nstate of New York, employees of any department or agency of the city of\nNew York or of the state of New York, employees of any municipality or\nother participating employer participating in the New York state and\nlocal employees' retirement system or the New York state and local\npolice and fire retirement system, and employees of school districts\nparticipating in the New York state teachers' retirement system.\n b. The term "ordinary death benefit":\n (1) shall include only the death benefits authorized by:\n (a) sections sixty, sixty-a, sixty-b, sixty-c, three hundred sixty,\nthree hundred sixty-a, three hundred sixty-b, three hundred sixty-c,\nfour hundred forty-eight, four hundred forty-eight-a, five hundred\neight, five hundred eight-a, six hundred six and six hundred six-a of\nthe retirement and social security law; and\n (b) section five hundred twelve of the education law; and\n (c) sections B3-32.0, B20-39.0 and B20-40.0 of the administrative code\nof the city of New York and\n (d) subdivisions a, b and c of section B18-38.0 of such code and\nsubdivisions a, a-1, b, c and f of section B19-7.79 of such code; and\n (e) section twenty of the rules and regulations of the board of\neducation retirement system of the city of New York; and\n (f) subdivision four of section B3-36.0 of such code, subdivision two\nof section B20-41.0 of such code, subdivision d of section B18-38.0 of\nsuch code, subdivisions d, e and f of section B19-7.79 of such code,\nsection two hundred seven-h of the general municipal law, as added by\nchapter nine hundred four of the laws of nineteen hundred sixty-six and\namended, section two hundred seven-h of the general municipal law, as\nadded by chapter nine hundred six of the laws of nineteen hundred\nsixty-six and section fourteen-a of the rules and regulations of the\nboard of education retirement system of the city of New York, in any\ncase where the death to which any of the provisions above mentioned in\nthis subparagraph (f) is applicable occurs before the effective date of\nretirement designated by the member or by the board of trustees of the\nretirement system, as the case may be; and\n (2) shall include the accelerated death benefit authorized by\nsubdivision nine of section five hundred eleven of the education law;\nand\n (3) shall not include a death benefit payable as the result of an\naccident sustained in the performance of duty.\n
