* § 136-d. Contracts involving industrial painting and industrial\ncoatings. 1. Any state agency contract for the application of industrial\npainting or industrial coating shall include provisions regarding\ncontractor, subcontractor and worker certification as follows:\n a. Contractors and subcontractors doing work involving industrial\npainting and industrial coating shall certify that all work completed\nmeets the minimum standards established under this section by the office\nof general services regarding industrial painting and industrial\ncoating.\n b. Contractors and subcontractors doing work involving industrial\npainting and industrial coating that require the disturbance of\nlead-based paint or other hazardous materials shall certify that all\nwork conducted on the project meets the minimum standards established\nunder this section by the office of general services.\n 2. Any certifications required by this section shall be kept current\nfor the duration of the contract.\n 3. The office of general services shall establish guidelines\nconcerning the procurement of industrial paints and industrial coatings\nas well as the qualifications required for the application of industrial\npaints and industrial coatings by contractors and subcontractors\npursuant to section one hundred sixty-three of this chapter. Such\nguidelines shall implement a certification process with minimum\nstandards for contractors and subcontractors to file with the\ncontracting agency upon completion of a project. When establishing\nguidelines related to industrial paints and industrial coatings, the\noffice shall consider industry standards set forth by the Association\nfor Materials Protection and Performance (AMPP) or other similar\nassociations that set industry standards for protective coatings and\nshall consult with affected contractors and subcontractors to consider\nenvironmental impact as well as the impact on public health and safety.\nThe office of general services shall establish contractor and\nsubcontractor requirements for employees working on industrial painting\nand industrial coating projects including, but not limited to, requiring\nspecific trainings or certifications for individual employees.\n 4. As used in this section, the term "state agency" shall mean the\nsame as defined in section one hundred sixty of this chapter.\n * NB There are 2 § 136-d's\n
