The New York state "drive out diabetes research and education fund"

§ 95-b. The New York state "drive out diabetes research and education\nfund". 1. There is hereby established in the joint custody of the\ncommissioner of taxation and finance and the comptroller, a special fund\nto be known as the New York state "drive out diabetes research and\neducation fund".\n 2. Such fund shall consist of all revenues received pursuant to the\nprovisions of section four hundred four-s of the vehicle and traffic law\nand all other moneys appropriated, credited, or transferred thereto from\nany other fund or source pursuant to law. Nothing contained herein shall\nprevent the state from receiving grants, gifts or bequests for the\npurposes of the fund as defined in this section and depositing them into\nthe fund according to law.\n 3. Monies of the fund shall be expended only for diabetes research and\neducation projects. As used in this section, "diabetes research and\neducation projects" means scientific research or educational projects\nwhich, pursuant to article twenty-seven-H of the public health law as\nredesignated by chapter five hundred eighty-four of the laws of nineteen\nhundred eighty-eight, are approved by the department of health.\n 4. Monies shall be payable from the fund on the audit and warrant of\nthe comptroller on vouchers approved and certified by the commissioner\nof health.\n 5. To the extent practicable, the commissioner of health shall ensure\nthat all monies received during a fiscal year are expended prior to the\nend of that fiscal year.\n
