§ 3. Incorporation. (a) A transportation corporation may be formed\nunder this chapter, in accordance with the procedure for the formation\nof corporations set forth in article four of the business corporation\nlaw, by delivering to the department of state for filing a certificate\nof incorporation entitled "Certificate of incorporation of . . . (name\nof corporation) pursuant to section three of the transportation\ncorporations law".\n (b) In addition to the statements prescribed by section four hundred\ntwo of the business corporation law, a certificate of incorporation of a\ntransportation corporation shall designate the particular kind of\ntransportation corporation to be formed, and shall state:\n 1. If a gas corporation, an electric corporation, or a gas and\nelectric corporation, the county or counties in which its operations are\nto be carried on;\n 2. If a telegraph corporation, a telephone corporation, or a telegraph\nand telephone corporation, the territory in which its operations are to\nbe carried on;\n 3. If a water-works corporation, the cities, towns and villages to be\nsupplied with water, and that the consent of the authorities of such\ncities, towns and villages required by this chapter has been obtained,\nand that such consent has been annexed thereto;\n 5. If a ferry corporation, the places from and to which the ferry is\nto run;\n 6. If a pipe line corporation, the places from and to which the pipe\nline is to be maintained, as nearly as practicable, and the county or\ncounties through which or in which it is to be maintained and operated;\n 7. If a freight terminal corporation, the limits of the locality in\nwhich its operations are to be carried on;\n 8. If a district steam corporation, the cities, towns and villages to\nbe supplied with steam and that the consent of the authorities of such\ncities, towns and villages required by this chapter has been obtained,\nand that such consent has been annexed thereto.\n
