* § 401. Stewart airport commission. 1. Upon assumption by the\ndepartment of transportation of jurisdiction over the airport facility\nand surrounding area located in the county of Orange, known as Stewart\nairport, there shall thereupon be created a Stewart airport commission.\nThis commission will be an advisory council to the commissioner with\nrespect to administration and management of the Stewart airport\nfacilities and its surrounding areas with respect to projects to be\nundertaken and operations and management of the facilities at such\nairport. The commission shall be composed of ten members of which six\nmust be residents of Orange county, two must be residents of Dutchess\ncounty and two residents from Ulster county. By virtue of their offices,\nthe commissioner of transportation or the commissioner's designee, the\nOrange county executive, the Dutchess county executive and the\nchairperson of the Ulster county legislature shall be ex officio members\nof the commission. The members of the commission shall be appointed by\nthe governor with the advice and consent of the senate and, except for\nthe initial appointment terms, shall serve for a term of four years.\nHowever, two of the appointments must be from a list submitted by the\ntemporary president and majority leader of the senate, and two must be\nfrom a list submitted by the speaker of the assembly. Initial\nappointments shall be to staggered terms with three of the nominees of\nthe governor being made to initial one-year terms and the other three\nnominees to initial four-year terms, the members nominated by the\nspeaker of the assembly to initial two-year and three-year terms,\nrespectively, and the members nominated by the temporary president and\nmajority leader of the senate to initial two-year and three-year terms,\nrespectively. If any member shall thereafter no longer meet the\nresidency requirement of his or her appointment, such position shall be\ndeclared vacant. In the event of a vacancy, the vacancy shall be filled\nin the same manner as the initial appointments except that the term\nshall be for the unexpired portion of the term of such members. All such\nmembers shall be deemed officers of the state in connection with the\nprovisions of section seventeen of the public officers law. The members\nof the commission shall appoint a chairman from among their number.\nMembers shall not receive a salary or other compensation, but shall be\nreimbursed for their actual and necessary expenses incurred in the\nperformance of their official duties.\n 2. The Stewart airport commission shall assist in the development of a\nprogram relative to the administration and management of the Stewart\nairport and to advise the commissioner of transportation with regard to\nsuch other programs relative to the Stewart airport as he may undertake.\nSuch program shall include, but not be limited to identification of\nfuture capital needs, examining the means and methods of financing such\nfuture capital needs, the promotion and examination of the financing\nmeans and methods for the economic development of the area around the\nairport, the joining together of such economic development and the\nairport operations, the identification and implementation of ways of\nworking with the local community to accomplish the program and the\nidentification of non-aviation uses and purposes and prorations of use\nor purposes for determinations of in lieu of tax payments. Once the\ncommission has been established, the commissioner and/or the department\nshall effectuate the authorizations, powers and/or duties set forth in\nsection four hundred of this article only following the consultation,\nguidance, advice and assistance of the commission. The Stewart airport\ncommission shall meet at least six times a year at the call of the\ncommissioner of transportation or the chairman of the commission and\nshall keep a record of all its proceedings and recommendations
