4.1-53-32. Tree seed and shrub seed - Label requirements

1. a. Each container of tree seed or shrub seed offered for sale or sold in this state, for

planting purposes, must be labeled.

b. The label must be plainly printed in English and conspicuously placed on or

attached to the container.

2. If seed is supplied in fulfillment of a contract for the collection and gathering of the

seed, the label requirements of this section may be met by an analysis tag attached to

the invoice if each container is clearly identified by a lot number stenciled on the

container or if the seed is in bulk.

3. If the seed is offered for sale or sold in bulk, the label must be provided to the

purchaser at or before the time of delivery.
