Ohio Rev. Code § 111.31

April 7, 2023 House Bill 458 - 134th General Assembly (A) Notwithstanding division (E)(2) of section 3509.03 and division (E)(2) of section 3511.02 of the Revised Code, the secretary of state may mail unsolicited applications for absent voter's ballots to electors for a general election if all of the following apply: (1) The general assembly appropriates funds to the controlling board for that particular mailing; (2) The secretary of state submits a request to the controlling board to transfer those funds to the absent voter's ballot application mailing fund established under division (B) of this section; (3) The request is accompanied by a report that includes all of the following concerning the most recent mailing of unsolicited applications for absent voter's ballots conducted by the secretary of state: (a) The number of applications mailed; (b) The number of those applications that were returned to the sender as undeliverable or otherwise were determined to be undeliverable; (c) The number of those applications that were completed and returned to the secretary of state or a board of elections; (d) The number of absent voter's ballots cast by mail in the election for which the applications were mailed. (4) The controlling board approves the transfer of funds to the absent voter's ballot application mailing fund. (B) There is hereby created in the state treasury the absent voter's ballot application mailing fund. The secretary of state shall use the fund to pay the cost of printing and mailing unsolicited applications for absent voter's ballots. The fund shall consist of moneys transferred to it by the controlling board under division (A) of this section.
