§ 759.48. Appropriation of property

January 1, 1966 Senate Bill 94 - 106th General Assembly When the officers having control or management of a public cemetery deem it necessary to appropriate property for a new and better approach to the cemetery, and have passed a resolution declaring the necessity thereof and their intention to make such appropriation, they shall make application to the court of common pleas or to a judge thereof in vacation, or to the probate court of the county in which the property or a part thereof is located, in the manner prescribed in section 163.05 of the Revised Code, and the proceedings therefor shall be conducted as prescribed by sections 163.01 to 163.22 , inclusive, of the Revised Code.
