Nondiscriminatory equivalent access to transmission and

distribution facilities.

Any person, firm, association, government agency, authority,

cooperative, corporation or any affiliate thereof seeking to use

electric transmission and distribution facilities of any retail

electric service distributor for the purpose of supplying retail

electric power shall be required to provide equivalent access to its

own electric transmission and distribution facilities on a

nondiscriminatory basis as a condition to the continuing use of the

electric transmission and distribution facilities of any other

retail electric service distributor.
