Liquid hazardous waste - Certain disposal prohibited

Official statutory text

- Exceptions.

A. The Department shall not issue a permit for the treatment,

disposal or temporary storage of any liquid hazardous waste in a

surface impoundment which is not generated by the owners of the

surface impoundment.

B. Except as otherwise specifically provided by law, the

disposal of any liquid hazardous waste in a landfill or in a surface

impoundment is prohibited.

C. The provisions of this section shall not prohibit:

1. The practice of soil farming of hazardous waste authorized

by the provisions of the Oklahoma Hazardous Waste Management Act;

2. The construction and operation of surface impoundments

solely for the collection of rainfall runoff; or

3. The construction of impoundments solely for the emergency

retention of spills of substances which are or may become hazardous

waste;

provided all liquids and associated solids are removed for proper

treatment or disposal in accordance with the rules promulgated by

the Board pursuant to the Oklahoma Hazardous Waste Management Act.
