Payment of assessment - Effect on rate increase or

Any member insurer who has paid an assessment pursuant to the

Oklahoma Property and Casualty Insurance Guaranty Association Act

shall include amounts sufficient to recoup a sum equal to the

amounts paid to the Oklahoma Property and Casualty Insurance

Guaranty Association by the member insurer, less any amounts

returned to the member insurer by the Association. Rates shall not

be deemed excessive because they contain an additional amount

reasonably calculated to recoup all assessments paid by the member

insurer in its next filing for a rate increase or decrease before

the Insurance Commissioner.
