Construction of sewage or drainage facilities into

operating or abandoned mine - Penalty.

If any person shall construct or cause to be constructed for

use, after the effective date of this act, any sewer or other method

of drainage from any building or dwelling house for the carrying of

sewage, offal, refuse or other offensive matter into any portion of

any operating or abandoned mine, such person shall be guilty of a

misdemeanor, and upon conviction thereof shall be sentenced to a

fine not exceeding One Thousand Dollars ($1,000.00) and shall be

imprisoned in the county jail, not exceeding one (1) year, or by

both such fine and imprisonment, at the discretion of the court.
