Expenditure of Corporation Commission Revolving Funds -

Uses.

In addition to other uses authorized by law, funds provided to

the Corporation Commission Revolving Fund pursuant to Sections 165,

177.2 and 180h of this title shall be expended as follows:

1. The Corporation Commission Transportation Division shall

employ four special motor carrier enforcement officers and one

supervisor-officer who shall have the primary duty of investigating

and assisting in the prosecution of persons engaged in unauthorized

transportation or disposal of deleterious substances as contemplated

under the provisions of the Oklahoma Motor Carrier Act and any other

applicable provisions of law. Such employees shall be compensated

as for similar service in the same or other departments of the state

and an expense allowance of One Hundred Dollars ($100.00) per month

for maintenance and cleaning of uniforms and other related expenses

shall be paid to such employees. Nothing in this section regarding

expense allowances shall be construed to mean that such employees

shall receive any additional compensation beyond what is provided

for maintenance and cleaning of uniforms and other related expenses

by the Corporation Commission on the effective date of this act.

2. The Commission shall purchase a sufficient number of motor

vehicles to provide each motor carrier enforcement officer employed

in the Transportation Division a motor vehicle suitable to carry out

the enforcement provisions of applicable law. Said vehicles shall

be appropriately marked as official vehicles and radio equipped.

All costs for operation, maintenance and replacement of the motor

vehicles authorized in this section shall be provided for from the

Corporation Commission Revolving Fund.

3. The Commission shall employ a hearing officer whose primary

responsibility shall be the adjudication of enforcement proceedings

and complaints brought against persons engaged in unauthorized

transportation or disposal of deleterious substances or other

unauthorized transportation in violation of the Oklahoma Motor

Carrier Act or the rules and regulations of motor carriers as

promulgated by the Corporation Commission.
