Street improvement assessments - Payment from fund

The Commission, upon the filing of a claim as hereinafter

provided, may pay and discharge out of funds accruing in the State

Highway Construction and Maintenance Fund any and all matured or

delinquent installments of special assessments for street

improvements which were levied against and constituted a lien upon

any real property acquired by the Commission for any purpose at the

time of the acquisition thereof, provided such assessments

constitute a valid lien upon the property at the time of the payment

thereof which, except for the immunity of the state from suit, could

be enforced in the manner provided for the enforcement of such

liens.
