§ 801.455. HEARING.

Official statutory text

(a) If a respondent requests a hearing pursuant to Section 801.407, the hearing shall be conducted by the State Office of Administrative Hearings.

(b) The State Office of Administrative Hearings shall consider the board's applicable substantive rules and policies when conducting a hearing under this subchapter.

(c) The administrative law judge shall:

(1) make findings of fact and conclusions of law; and

(2) promptly issue to the board a proposal for a decision as to the occurrence of the violation, any recommended license sanction, and the amount of any proposed administrative penalty.
