Mr. Lee has substantial experience in conducting internal investigations regarding possible violations of the Foreign Corrupt Practices Act (FCPA) and other laws.  Mr. Lee has conducted internal investigations into alleged FCPA and similar violations in Latin America (Mexico, Colombia and Brazil), Asia (Thailand, Indonesia, Taiwan, the Philippines, and China), Europe (England, Russia, Germany, and Spain), and the Middle East (Israel and the United Arab Emirates).  Mr. Lee has conducted investigations into other alleged violations of U.S. laws, including allegations of title reinsurance kickbacks, backdating of stock options, misuse of funds held by a California charitable trust, and alleged accounting irregularities at a large private university.  In connection with these investigations, Mr. Lee has represented companies in voluntary disclosures to, and negotiations with, the United States Department of Justice, the Securities & Exchange Commission, the California Attorney General, and the California Commissioner of Insurance.. Mr. Lee has counseled major U.S. companies on internal corporate controls and compliance issues and has drafted FCPA compliance programs for U.S. companies.  Mr. Lee has assisted GE and The Boeing Company in drafting procedures for conducting internal investigations.. Mr. Lee has argued cases before the Ninth Circuit Court of Appeals, the California Court of Appeal, and the Judicial Panel on Multidistrict Litigation.  Mr. Lee has tried cases in Los Angeles Superior Court and the United States District Court for the Central District of California.

Mr. Holmes' practice focuses on complex civil litigation, securities enforcement defense, and other regulatory defense. He represents clients in a broad range of fraud-based matters, including SEC and CFTC investigations, grand jury investigations and criminal and civil litigation involving allegations of financial fraud and related allegations of malfeasance. He also represents clients in proceedings before FINRA, the Department of Insurance, Department of Real Estate, and Board of Accountancy.. Mr. Holmes, an accomplished trial lawyer, recently completed a federal trial regarding securities law claims (defeating all claims of fraud against his client), obtained an approximately $1 million decision in favor of his plaintiff client in a breach of fiduciary duty case tried in state court, obtained an over $1 million award for his client following a securities arbitration, obtained a state court trial verdict for another client (the plaintiff in a breach of contract and fraud case), and obtained a nonsuit for his client in a jury trial following the close of the plaintiffs' case - and these are only a few of his many favorable trial results. Mr. Holmes has also represented clients in appellate matters (most recently affirming a state-court post-trial result he'd earlier obtained for his client), as well as before the Ninth and Tenth Circuit Courts of Appeal (in securities-related matters), and the Delaware Supreme Court (finding in favor of Mr. Holmes' client). While at the SEC, Mr. Holmes led SEC investigations and injunctive/administrative actions, and since entering private practice, has defended - at the investigative and litigation stages - numerous such actions.. Prior to founding what became Holmes, Athey, Cowan & Mermelstein LLP, Mr. Holmes was a shareholder in a Los Angeles-based white collar criminal and civil litigation firm, and was Of Counsel to two national law firms. He also served as a Staff Attorney in the Enforcement Division of the United States Securities & Exchange Commission, and as Corporations Counsel in the Enforcement Division of the California Department of Corporations (now known as the "Department of Financial Protection and Innovation", or DFPI). While at the California Department of Corporations, Mr. Holmes was a founding member of the Internet Compliance and Enforcement ("ICE") unit, and while at the SEC, Mr. Holmes was a member of the Internet Enforcement Branch.

Mr. Herrera was born in Los Angeles and raised in Koreatown, just west of Downtown. Mr. Herrera attended and graduated from California State University, Northridge with a bachelor’s degree in History. Thereafter, he attended Thomas Jefferson School of Law in San Diego and graduated Magna Cum Laude in May 2012 with a Juris Doctorate degree.. While at Thomas Jefferson, Mr. Herrera interned at the San Diego Alternate Public Defender’s Office, where he was involved in all aspects of juvenile criminal matters. He primarily dealt with DUI, drug possession and smuggling, and illegal entry cases.. Mr. Herrera also worked for a CPA/attorney in North County San Diego as a post-graduate law clerk. During that time, he helped represent clients in tax matters before the FTB, EDD, and IRS. He helped draft estate plans, including trusts, powers of attorney, and advanced healthcare directives. He also administered an irrevocable trust with a net worth over $2 million.. After living in San Diego for several years, Mr. Herrera decided to return back home to Los Angeles to be closer to his family and provide legal services to the community where he grew up. Mr. Fuchs obtained a Bachelor of Science Degree in Mechanical Engineering in 1968 and a Law Degree from the University of Southern California in 1978. After an initial stint following gradulation from Columbia, as an engineer for Chrysler Corporation in Detroit, I migrated to Los Angleles and was Technical Editor of Hot Rod Magazine and Engineering Editor for Motor Trend Magazine, from 1971-74, before obtaining my law degree in 1978.  I started my law career at Latham & Watkins from 1978-81 and have had a my own law firm or a small partnership since 1983.  I am an avid car enthusiast and over the years have owned several Porsches, several Mercedes, a Ferrari, and most recently a Dodge Viper GTS.  I have regularly participated in track events and for nearly 20 years have been a navigator in the Silver State Classic Challenge in Nevada, in the 150 mile per hour class.   I am an active member of Checkered Flag 200, a support group for the Petersen Automotive Museum, and I have handled a number of lawsuits and disputes involving collector cars such as Ferraris, Porsches and even some old race cars, as well as many business disputes, financing disputes and construction defects cases..
