five infringement appeals before the United States Court of Appeals for
the Federal Circuit, one of which remains pending.. Mr. Weiss's recent IP litigation accomplishments include:. Represented

clients' positions with respect to ownership and infringement issues,
following lengthy trial and post-trial and plan confirmation
proceedings.. Represented the defendant in a
trademark infringement action in Arizona District Court involving
claims relating to the name of an NBA arena. Confidential settlement
achieved following representation at evidentiary hearing in connection
with plaintiff's request for a preliminary injunction.. Obtained
reversal of summary judgment in favor of an infringement defendant,
with the Federal Circuit holding that there was a material factual
issue with respect to infringement under the doctrine of equivalents
(1998 U.S. App. Lexis 10416 (Fed. Cir. 1998)). Obtained
reversal of summary judgment of patent invalidity, based on the alleged
failure to name an inventor (216 F.3d 1372 (Fed. Cir. 2000)). The
Federal Circuit's decision in this appeal interpreted the second
paragraph of Section 112 of the Patent Act, one of the basic laws
governing the validity of issued patents. Irah Donner, the author of
Patent Prosecution: Practice and Procedure Before the U.S. Patent
Office, has called it a "key" Federal Circuit decision. It has also
been the subject of at least one law review note. See Janet S.

settlement.. Represented defendant in patent
infringement action in Eastern District of Texas relating to wireless
location technology. Case resulted in pre-trial settlement.. Represented

California relating to harvesting technology. Case resulted in

of products, components and technologies, and has particular expertise
in the medical device, mechanical, and business method areas. In 1992,
he appeared before the United States Court of Appeals for the Federal
Circuit, and persuaded the Court to reverse a unanimous decision of the
Board of Patent Appeals and Interferences, denying patent protection to
a football shoe having break-away cleats. (26 U.S.P.Q. 2d 1885 (Fed.
Cir. 1993)). The New York Times profiled that patent, U.S. 5,255,453, as one of its patents of the week. He has also argued before the Board of Patent Appeals and Interferences.. Mr. Weiss also conducts infringement studies, issues patentability opinions, and negotiates licensing agreements.. I'm a dad who know what it’s like to worry about what might happen.. As parents, we want to provide for our children and set them up to succeed, even if we’re not there. But estate planning can seem daunting.. I have learned firsthand that the best way to avoid family conflict in probate is to anticipate and plan around it. Before I narrowed my practice to this field, I advocated for the injured, the accused, and the disabled in proceedings before various civil and administrative courts.. I enjoy delving into emerging legal issues and finding cutting-edge solutions, boiling them down into valuable strategies that are both helpful and straightforward for clients.. I have my B.S. in Political Science from Utah Valley University, as well as my J.D. from Reuben Clark Law School at Brigham Young University. I have been admitted to the State Bar of Arizona.. In my free time, I spend time with his wife Alex and their two rowdy boys. This means his latest hobbies include playing hide-and-seek, doing somersaults in the backyard, and running circles around the dining table. When the occasion permits, he enjoys board games, sports, and kayaking.
I'm a 22-year lawyer, practicing in the areas of complex family law and civil litigation. Most of my cases are high-conflict. I am acutely aware that my job is not to make my clients' relationship with their (soon-to-be) ex worse. Years after you forget my name, you'll have to deal with the person with whom you're fighting now. I am a results-driven, solution-oriented lawyer. My job is to work myself out of a job. Each of my clients has my cell phone number. I am never, ever, out-of-touch. In addition to my practice, I'm an adjunct professor, teaching family law at Arizona Summit Law School.. I'm 47, originally from New York City, but lost the accent years ago. I'm married with two teenaged boys. In my spare time, I write fiction, articles, and collect pinball machines.

I also have experience placing liens on properties and also knowledge of Federal Law and employment regulations.. I also protect the interests of my client and employees by making sure protocals are followed and the risk is minimal.
I went to law school because I wanted to make a difference in people’s lives and protect my own family. I was naturally drawn to the practice of estate planning because of its positive nature and ability to impact people. Estate planning is positive?! Absolutely. When most people think of estate planning, they’re thinking that it’s only for the rich or the elderly. What they don’t realize is that estate planning is really about leaving a legacy – no matter how big or small – and ensuring that your loved ones are taken care of should you pass unexpectedly. Protecting families with children is especially important to me. My studies revealed a gap, a great chasm if you will, between traditional estate planning and what families really need. This gap could land your children in foster care, put a stranger in charge of their inheritance (who will take fees for that service), and leave your estate vulnerable to predators even if you have a will in place. I have made it my mission to obliterate this gap for my clients—guarantee their children stay in the care of people they know and trust, ensure funds are available for the immediate care of their children, and safeguard their values, beliefs, stories, and experiences! If you want someone that can act as a guardian of your legacy, who deeply understands estate law and can be your trusted advisor in the process of protecting your family, I encourage you to contact me!
I was raised in Southern California and married Katherine, the love of my life in 1979. We have five children and eight grandchildren, and counting... We raised our family in Mesa Arizona where I have worked my entire career. I have been involved with everything from Little League to United Way to junior high musicals, where I played the trumpet in the pit.. I love what I do. I give people peace of mind, setting up a Plan so their family won't have to hassle with a probate case. I especially enjoy helping small business owners and licensed professionals separate their personal wealth from their potential liabilities.
I was a Legal Assistant for 13 years before starting law school, working in the area of estate planning, probate, guardianship/conservatorship, and tax.. Prior to law school I worked as a corporate acountant for a major computer software firm.. I have two grown children and four grandchildren.
I strive to create a trusted and long-lasting relationship with every client I represent. My goal is to work harder and achieve better results than other attorneys could if given the same case and client. I pride myself on taking challenging matters including cases that most attorneys consider too complex or risky to handle. I am a trial attorney who has obtained six figure and seven figure verdicts in both state and federal court. Aside from being an attorney, I am a cancer survivor, triathlete, spartan-racer, author, husband, father and step-father. When I am not winning cases, I enjoy spending time outdoors with my family or training for my next athletic challenge.
I practice law in the areas of personal injury and wrongful death. I take a special interest in representing individuals who have been involved in motor vehicle accidents that were caused by someone else’s fault. I also have an extensive background in defending individuals and entities who have been sued for negligence claims involving motor vehicle accidents, premises liability, and wrongful death. Having practiced from both a plaintiff and defense perspective gives me a unique advantage in understanding and anticipating both sides of a dispute in order to best advance a client’s position.

I only represent injured victims and we only take a select few cases with serious injuries or death so we can put in the necessary time to help you recover full and fair compensation. I am licensed to practice in 4 states, but handle cases all across the country.
I have provided personal service to my clients for over 30 years. As a former Magistrate I understand the systems of the Court and Judges. Since I am a sole practitioner I able to give my clients very personal attention.
I have practiced commercial/business litigation since graduating from BYU law school in 1976. Tried more than 100 jury trials. I love the courtroom. I prepare and trial cases electronically because it increases efficiency and lowers costs. All client documents are scanned and bates-labeled, so that complete chronologies can be prepared. A chronology is vital to understasnding the case and preparation. It, also, allows for designation of trial exhibits and preparation of exhibit lists using the computer rather than hand-sorting and hand-description of exhibits. Exhibits can be annotated electronical for effective trial work, and I use the computer equipment in the courtroom myself: there is no disconnect between the examination and getting the document on the screen for the witness, jury, and judge.. Computer images are used in depositions rather than paper exhibits because of the increased efficiency and the resulting lack of disconnect when depositions, which I always videotape, are played at trial. The talking head and the document can be displayed for the jury, and the bates number assures the jury that the same document marked and used at trial is the one about which the witness is testifying. The images allow a free-ranging deposition rather than one limited the stack of documents on the table.. We have the necessary computer programs to process native-file electronic documents (ESI or electronically stored information). Metadata is essential in many cases. We, also, have the right computer forensic help for imaging and use of client and adverse-party computers.. My longest jury trial lasted ten months, a securities fraud trial with more than 10,000 exhibits marked. It was eash to manage becuase of technology. My largest jury verdict resulted in a judgment of more than $60 million. I have traveled internationally for cases and, of course, all over the United States. Tried cases in many states.. I was an adjunct professor of law at ASU lawschool for two years teaching electronics in the courtroom.. I have done cases on a budget and cases where the amount at issue was such that there was no budget. My fees tend to be less than other lawyers because of the efficience of the electdronics used for prepartion, management, and trial. I, also, expect the client to help me know where to look for evidence in the field of discovery so I do not have to turn over rocks where there are no worms.. I have an economics degree, which helps in the sorts of cases I try. Cases that generally involve economic and accounting experts. It is easier to prepare an expert or cross the other side's expert if you have background in the subject area.. I have a commercial pilot's license with more than 4,000 hours of flight time, less than 80 hours of which is in single-engine aircraft. I know airplanes, the FARs, and all things aviation, so there is no or very little learning curve when the case is aviation related. I have represented pilots, FBOs, Part 135 operators, and Part 145 repair stations.. I am a trial lawyer. That means I want to try the case. My job is to get the case ready to try and try it, not ready to settle. I am at home in large-document cases involvintg complex legal issues. I prefer the courtroom to the office. Interviews, discovery, and everything pre-trial (office work) is to get me to the courtroom.
I have over twenty years of experience litigating religious liberties cases and advising religious institutions on a wide array of matters including employment, tax, zoning and land use, corporate formation, bylaws and policies, litigation, and administrative and regulatory matters. My representation focuses on ensuring that ministries and churches have the legal space to minister freely. In today’s legal environment, churches and ministries need skilled legal counsel to navigate challenges that can negatively impact their ministries. I have a history of providing my clients solid legal representation together with a missional mindset that understands the ministry world. A proven litigator, I also represents clients in commercial litigation and business matters.
I have had the great pleasure to practice estate planning, elder law, and special needs planning for over 20 years now. I enjoy and appreciate the opportunity to work with seniors, disabled individuals and families to provide holistic and comprehensive solutions for their unique legal and financial concerns.. As a Phoenix native, I like to give back to the community and frequently speak on the various topics of estate planning, elder law or special needs trust for community groups as well as the State Bar of Arizona, AzNAELA, and Maricopa County Bar Association. I also presently serve on the Board of Directors for PASRS.. My firm has grown over the years to be one of the largest and most expereienced in what we do, and I am immensely proud to work with such caring and talented attorneys and other dedicated professionals. When I say my co-workers are like family, a few truly are. My husband is our firm manager, and my sister-in-law and brother-in-law work with us too. In addition, several of the paralegals have been with me for over 10 years. We all work as a team and treat our clients like family.. When not at work, I enjoy spending time with my husband of 25 years and my two children, Jack and Sarah. We enjoy activities together like travel, hiking, kayaking, and mountain biking.
