I am a trial lawyer and am certified by the Minnesota State Bar Association as a Criminal Law Specialist. I am a Winona native and attended Winona Senior High School, Winona State University and the University of Minnesota Law School. I practiced with a national law firm in Minneapolis for several years before returning to Winona in 1988 and joining the law firm of Darby, Delano and Price. While with the firm, I tried a number of major felony cases, including robbery, narcotics, burglary, assault and criminal sexual conduct. In addition, I successfully represented many injured persons in accident and negligence cases. I left the firm in 1993 to enter government service with the Third Judicial District Public Defenders Office, where I served as Chief Trial Lawyer, handling serious felony trials across southern Minnesota. I left government service in 2003 to join with Michael J. Price and John Paul Plachecki to form the law firm of Price, McCluer and Plachecki.. I have been lead counsel in over 250 jury trials, including homicide, robbery, kidnapping, narcotics, criminal sexual conduct, burglary and assault.. Outside of legal practice, I served as a faculty member at Winona State University from 1988 to 2011. I am active in teaching traditional Japanese martial arts, and serve as counsel, officer and board member for several non-profit organizations.

Beau received his undergraduate degree at South Dakota State University in Brookings, South Dakota, and his law degree from William Mitchell College of Law in St. Paul, Minnesota. He is a member of the Minnesota State and the Winona County Bar Associations.. Beau represents clients in criminal defense, DUI/DWI cases, family law, landlord/tenant disputes, debt collection, and real estate matters.. Beau is married and has four wonderful children. He enjoys playing and watching sports and is very active in the community. After working in a firm for the first four years out of law school, Candice opened her own law practice in Sparta, Wisconsin.  While she thoroughly enjoyed the six years she spent working across multiple counties and a wide range of legal areas, Candice sought and received a judicial appointment to complete a term as La Crosse County Circuit Court Branch 5 Judge.  Now that her term has concluded, Candice has returned to private practice with increased skill and knowledge to better serve her clients.

Marcus' passion for criminal law began as an intern for the Plymouth County District Attorney's Office. During his tenure, Marcus developed a working knowledge of court, prosecution, and police procedure. He expanded his knowledge of the subject while studying Criminal Justice at Bridgewater State University, where he graduated compiling multiple academic honors. He then attended University of Massachusetts School of Law as a recipient of an academic scholarship. During his time at UMass Law, Marcus was involved in several student organizations, including the Criminal Law Society, which would often educate general public about the institutions of and new developments in criminal law. Following his graduation from UMass Law, Marcus was admitted into the Massachusetts Bar as a licensed attorney.. My name is Joe Bernard. I have practiced in Hampden County, Springfield Massachusetts for over 20 years and reside in Belchertown, Massachusetts. I was in the District Attorney's Office for approximately four years and for the last eighteen years have been doing a great deal of criminal defense. I've tried well over three hundred cases in the Hampden, Hampshire, and Franklin County Superior Courts, as well as district courts across western Massachusetts. For over twelve years I was a member of the CJA panel here in western Massachusetts.. As of late, I have focused almost exclusively on representing individuals charged with driving related offenses. I have always had an interest in the area of the area of the law and in 2012 I attended and successfully completed the certification process from the National Highway Traffic Administration (NHTSA) to administer standardized field sobriety tests.. I regularly lecture and have have been actively involved with the Massachusetts Bar Association, MCLE and other continuing legal education agencies, specifically within the area of driving under the influence. I also co-wrote a chapter concerning trial preparation for the 2007 edition of Trying OUI Cases in Massachusetts,  published by Massachusetts Continuing Legal Education, Inc. (MCLE).. Recently, I became involved with the Melendez Diaz challenge in Massachusetts. I represented a woman in the Appeals Court (79 Mass. App. Ct. 1129 (2011) which was one of a group of cases decided by the Supreme Judicial Court within Commonwealth v. Zeinnger 459 Mass. 775.. More recently, over the last 2 1/2 years I have been challenging trial courts in western Massachusetts attempting to get a court order to obtain training on the Draeger 9510. I have had an ongoing dialogue with the Draeger company attempting to convince them that Massachusetts lawyers need and deserve training on this machine. As far as I know this is one of the only pieces of forensic equipment not available for viewing or purchase on the open market.. Finally, several judges in western Massachusetts agreed with my request and have issued an order to provide training for myself as an expert on the machine. This order was served upon the Office of Alcohol Testing and the state police. Subsequently, the Commonwealth appealed and challenged the order before the Supreme Judicial Court. In July 2015 the Supreme Judicial Court of Massachusetts agreed and in Commonwealth v. Nunes ordered that Massachusetts lawyers and their experts receive training on the Draeger 9510.. I am one of the five lead lawyers in Commonwealth v. Evando Ananias et al. which is further exploring the the Nunes decision and carving out new territory allowing attorneys to be able to better defend their clients in similar matters where a breath test was used.
