Sick time hours I was asked to use were never paid out.

Location: California Here’s my situation. I put in my two weeks notice at my previous employer with my last day being the 11th of August. I had a shift scheduled the 9th in which I called off sick and my boss said hey want me to use sick hours and let’s make today your last day. I said sure given the fact that there was no point in continuing since I was starting my new job already. Thing is I never got paid those sick hours, I even have texts from my boss showing she said she was gonna put in my hours of sick time. I guess my question is I know I can file a claim but will I get paid penalties for that time? I know California treats sick time different than earned time. Should I file just for the missing sick hours or also penalties, anyone can provide clarification thank you
