Location: California. Left apartment July 31st. The lease says very little other than to broom the place before leaving. Literally ‘broom’ btw, not sweep. The LL has been saying he will deduct cost of paint and painter from my security deposit but on what grounds? He also said I will receive it back on August 21 but I had to text him at the end of the day and he said meet at the property Sunday. It’s been less than 5 years. He has been rude and sketchy. Location: California Type: tenant/rental/real estate law question. I am curious how these different factors may affect the return of a security deposit. I rented an apartment in California for 4 years and completed an initial move-out inspection. The checklist required replacement of 5 window screens, but I managed to replace only 4. The last one just wouldn't fit in my car. Despite this, I was charged more for the missing screen than the cost of all four at the same service provider. (Four windows about $80, the large screen they took they're charging $130 for). Additionally, I was informed by the landlord that they planned to repaint the whole apartment and redo all the floors and baseboards due to pre-existing problems, so I shouldn't bother cleaning them. However, I was later charged $200 for cleaning and there is currently no provided invoice for that cleaning. My lease did not specify a timeline for the return of the security deposit, but I understand that California law mandates a 21-day period. I handed over the keys on July 30th and fully vacated the unit, the lease officially ended at noon on August 2nd, and it's now August 21st. I received the first communication today, an estimate stating they would further hold my deposit until they get the cleaner's invoice. There are not additional repairs/charges they're waiting on, rather they're withholding it even longer because they're waiting on a receipt from a cleaner. Location: California I recently moved out of my former roommate's apartment. I was not on the lease nor does the agreement he typed up and made me sign have a clause that says I must pay him. (His landlord was not aware I was living there and he actively used to push me out of the apartment during inspections.) location: California I have tried so much to stop this: several dozen contacts to lawyers to try to enlist help, aid organizations (quick denials—don't meet basic requirements like the correct ZIP code or skin color), my own court filings (link below redacted most recent filing, the content of which the judge essentially ignored informing me that I could not be considered without representation). I've most recently been trying to secure a last-minute mover with storage to at least try to preserve my things (have nowhere to go and am homeless now without all personal effects, meds, IDs, keys to vehicles and vehicles themselves, work items and computers, etc. due to the abusive sheriff's lockout that disallowed me from gathering essentials). Location: California Hello, I am subleasing with a guarantor, month to month. In the sublease it states that the subleaser is responsible for me (subleasee) if I do not pay the rent. I must also give a 30 days notice to my subleaser before ending the sublease. I have lived here 2 months and I just found a new place and I am moving out of this current one with only 15 days notice to my subleaser. Here is the legal advice help part: The sublease I signed was never fully completed. My subleasee wants the rent money on the 25th (Main Landlord requires rent on the 1st). This was not filled in on my sublease when I signed it. I never recieved the final copy of the sublease with everything completed. If I don't pay the rent, will my Guarantor be contacted and charged the amount of the rent for the 1st? Is the sublease even still valid despite never recieving the final copy? These people already scammed me out of an extra $500 a month compared to the previous cost of the room in order to make their rent lower for their room (Massive 6 bed house, 8 people total, rent for each person/room was decided by one of the household members not the landlord).
