During law school, Mr. Chayet's grandmother, Letty Milstein, was the principle party in one of the most controversial and public elder law cases in the state of Colorado. The Estate of Milstein v. Ayers, 955 P.2d 78 (Colo. App. 1998), is a landmark probate case which upholds and protects the right to counsel and due process of incapacitated adults in Colorado and has been codified into the Colorado Uniform Protective Proceedings Act (the guardianship and conservatorship laws). This experience was the impetus for Mr. Chayet's career long practice commitment to the field of elder law and probate litigation.. Mr. Chayet is the Co-Chairman of the Elder Law Section of the Colorado Bar Association and the recipient of Colorado Super Lawyers 2009 Rising Star in Elder Law. A sampling of Mr. Chayet's broad experience in elder law and complex probate litigation includes: Litigating contested guardianship and conservatorship proceedings for adults and minors; Litigating will contests and fiduciary defense actions; Representation of guardians, conservators and fiduciaries; Trust administration and trust litigation; Drafting complex wills and complex trusts; and Contested and non-contested estate administration.. Mr. Chayet's expertise in the area of elder law has also been demonstrated through his publishing in the areas of elder law as well as public speaking appearances including appearing on the Colorado television show Senior Survival, being a frequent guest lecturer for the University of Denver College of Law Institute for Advanced Legal Studies, and lecturing on various elder law topics for Continuing Legal Education International, the National Academy of Elder Law Attorneys and the Colorado Bar Association.. Mr. Chayet is an active member of the National Academy of Elder Law Attorneys where the Academy asked Mr. Chayet to serve on the Academy's Membership Committee, Practice Development Committee as well as serving as an officer of the Colorado Chapter of NAELA. Mr. Chayet continues to be an active member of the Colorado Bar Association where fellow Colorado attorneys nominated Mr. Chayet to be a Fellow of the Colorado Bar Foundation.. I am a general practice attorney, which is a little bit like a family doctor that you go to for a variety of needs. I find that because I practice in several areas, there is cross-over that allows me to know when one legal issue I am handling affects other areas of my client's life and adjust my advice and work accordingly. One unusual thing about my practice is that I offer legal consulting. Most attorneys require you to retain them to handle your case from start to finish. In addition to doing that, i also consult with people who can't afford to retain an attorney. This means clients pay according to their budget and according to their priority questions and concerns. My commitment to my clients is a realistic appraisal of their legal problem, practical solutions, compassion and honesty in all aspects of my service. I offer free consults to allow prospective clients to get some information at no cost while determing for themselves if my law office is the best fit for their needs. Call us to arrange a free consult and we'd be glad to talk with you. I am currently working virtually which means that I can talk to you by phone or video meeting and email. I can do wills and related documents virtually so that you do not need to come to my office unless you choose to use notary services there. I'm also doing other work like bankruptcies in a similar cases that require hearings are being done by phone or other virtual means.
