Michael Cerasa takes on big companies, but he works for individuals. He understands that every client is unique. Michael Cerasa will listen to you AND develop a winning strategy for your claim.. Michael has been representing people injured in accidents or from defective drugs or medical devices for nearly 20 years. His goal is to offer clients the experience of a big law firm coupled with the attentiveness of a smaller practice.. Born in Massachusetts, Michael fell in love with Central Illinois after relocating to Champaign with his family. Michael attended the Florida State University College of Law, where he graduated cum laude. He began his professional career in law in Florida immediately after and has been admitted by state bars in Illinois and Florida, Florida’s Northern, Middle, and Southern districts as well as the 11th Circuit Court of Appeals. A longtime advocate for accident victims, attorney Cerasa is focused on holding negligent people responsible for their carelessness or greed and making sure that injured folks understand their rights and don’t get ripped off by insurance companies.. He has been named a Super Lawyer, holds a 10 out of 10 rating on AVVO, and has been ranked as one of Florida’s Top 100 Civil Plaintiff Trial Lawyers by the National Trial Lawyers.. Michael will listen to what happened in your accident, your concerns, and your needs. Together you will decide the best legal route forward to winning you the compensation you need to fully recover. He will be with you every step of the way and you can count on him to be attentive, available, and ready to answer your questions.. During negotiations with the insurance companies and in court, you’re going to see the passion he has for his work. You will see the pride he takes in fighting for people when they’re down and out following a bad accident.. With deep knowledge of Illinois and federal law and an aggressive strategy, Michael holds the doors open when the insurance companies try to shut you out. Using the evidence he’s collected in a thorough investigation, witness statements, hard-to-find documents, and citing legal precedent, he will demand the settlement you are owed. If an insurance company decides to be unreasonable and refuses to budge from a lowball offer, he is more than happy to go to trial and beat the providers in front of a judge and jury.. Michael is dedicated to the people of Central Illinois and the Champaign-Urbana area. He lives in the city with his wife, Jennifer, and their three children. Michael also recognizes the area’s challenges – dangerous, congested roads and highways with high numbers of crash fatalities, and too many car accidents involving tractor-trailers and pedestrians.. To help support and provide counsel to the injured in our community, The Cerasa Law Firm P.C. offers free case consultations, in which you can talk over your case with a member of our legal team and weigh your best options. There is no obligation to hire us after the claim evaluation.. Our law firm also takes all cases on contingency, which means that you pay no upfront costs, no out-of-pocket expenses, no retainer fee, and no hourly rate. If we take your case on contingency you will never have to worry about paying a lawyer’s fee. We don’t get paid until we win.. If you or a loved one has been injured in an accident, contact us. Several years ago he was seconded to theLondoninsurance market where he worked directly with leading Lloyd’s claims and underwriting personnel to manage complex litigation, analyze claims, counsel on contract wordings, and assess risk. Josh also previously served for three years as outside counsel for a bedding manufacturer, managing claims and providing transactional advice.. Josh has been a featured speaker at approximately 35 seminars, including seminars conducted across the U.S.and in Europe. His recent presentations at major conferences have focused on data security and cyber liability issues, e-discovery and crisis management litigation strategies. Josh has been interviewed by Business Insurance and Metropolitan Corporate Counsel and also has published articles on cyber liability and litigation tactics.. Prior to moving to Chicago, Josh spent a semester in law school at the Université Aix-Marseille in Aix-en-Provence,France, in 1988; interned at the U.S. Claims Court inWashington,D.C., for a federal judge in 1989; and practiced in New Orleans for five years.. Practice Details. Cyber Liability. In the area of cyber liability, Josh has recently: (a) successfully defended a media network that provides interactive online advertisements in a high-exposure, high-profile cyber class action matter; (b) worked with counsel in Florida and Washington State to defeat the plaintiff's complaint against an online legal rating agency, upholding the client’s right to post its ratings of lawyers and doctors online; (c) negotiated the favorable resolution of a complex and highly publicized multimillion-dollar data theft claim against a technology service provider for slightly less than 20 percent of the value of the multi-million dollar claim, despite evidence demonstrating that the service provider was responsible for the loss. The claim, pursued by several major U.S. banks and credit card issuers, involved coordinated theft of data in transit from hundreds of automatic teller machines; and (d) won dismissal of claims brought by a putative class of 82,000 individuals against a health care service company alleging negligence and violation of the Stored Communication Act, Illinois Personal Information Protection Act, HIPAA and Illinois Consumer Fraud Act.. Through aggressive litigation and savvy negotiations, Josh was able to attain a settlement at a significant discount off of the $25 million policy limits claim. He achieved a highly favorable settlement for another client in a D&O coverage dispute due to hisdiscovery of a policy defense that had been missed by the client’s former counsel. Josh also has a growing practice in professional liability defense.. Bad Faith and Punitive Damages. In the area of bad faith and punitive damages, Josh has: (a) first-chaired a first-party bad faithinsurance coverage trial for certain London market insurers in an unfavorable southern U.S. venue involving more than $25 million in claims.
