Location: Ohio My mom wants to change her will due to my brother's impending divorce. Instead of my brother and I splitting everything 50-50, I still get half but his half will be split between him and his ex-wife. Everyone involved is fine with that. However, my mom's friend/executor, who's suddenly involved in all of her finances, has told her that she needs to remove us as beneficiaries from all of her bank accounts because the accounts can't be split unevenly (according to her they can't be split 50-25-25, if there are 3 of us as beneficiaries we will each get 1/3). From everything that I've read, that's not true at all and splitting 50-25-25 is not only possible but the best thing to do. It's my understanding that as beneficiaries on all of her accounts the money would go straight to us after her death (and appropriate paperwork obviously) and bypass probate and the associated fees. My mom is in assisted living and has sold off her houses, cars and pretty much everything else. She has a significant amount of money in several investment and retirement accounts and really nothing else. So if her bank accounts go through probate then the probate costs go from almost nothing to nearly $100,000, and the fees paid to the executor (who is the person feeding her this information) go from almost nothing to tens of thousands of dollars.
