Chad Henson assists clients in all legal matters related to patents and other areas of intellectual property litigation and other business litigation. He has built substantial experience in patent damages and the intersection of patent law with administrative and antitrust law. He works with industry clients, financial institutions, and law firms to analyze and solve complex problems at the intersection of law and economics and has litigated cases involving a broad range of technologies, including lighting, optics, wireless networking, machine-to-machine communication, and consumer electronics.. Before entering private practice, Chad held academic and research positions at nationally recognized institutions around the United States, including the University of Illinois, Washington University in St. Louis, the Mercatus Center at George Mason University, the Property and Environment Research Center, and the Institute for Humane Studies. He has also served as a consultant to professional and academic research institutions, law firms, and financial services firms, and his scholarly work has been published in leading journals in the fields of law, economics, and finance. He has also given presentations on patent damages, use of data analytics to predict judicial decision-making, and economic analysis of law at various conferences and seminars.. Chad previously spent time as senior litigation counsel for a company focused on providing in-house legal solutions to individual inventors and small companies to monetize their intellectual property.. Obtained en banc ruling that the 35 U.S.C. § 314(b) prohibition on appeals of decisions to institute inter partes review does not preclude review of the timeliness of an IPR petition under § 315(b), reversing multiple panel decisions.Represented plaintiffs in patent infringement action as member of four-attorney team that secured a $25 million settlement just prior to trial and obtained over $100,000 in fees on a motion to compel.Represented plaintiff in suits arising out of undisclosed liabilities in merger transaction. Cletus grew up in Cuero, Texas. He is a graduate of Woodberry Forest School (1986), Trinity University (1990) and Thurgood Marshall School of Law (1995). He also attended the University of Houston as a graduate student, focusing on American History. He began his law career in Houston working for the law firm Taylor & Cire, a personal injury litigation firm that handled a variety of injury and death related cases on behalf of plaintiffs. Mr. Ernster’s law practice experience has included personal injury, civil rights, employment discrimination and racial profiling litigation. In addition, he worked on the Texas Supreme Court case Haussecker v. Childs, 974 S.W.2d 31 (), a legal malpractice lawsuit. As an attorney, he has been recognized for achievement by the Texas NAACP, receiving a 2005 Special President’s Award. In that same year, the NAACP Houston presented him with an Alex Award for Legal Excellence. In addition, Mr. Ernster has received Congressional Recognition for outstanding efforts to fight for racial justice and equality for all and was a guest speaker at a University of Texas Symposium on Consumer Racial Profiling. He is a member of the State Bar of Texas, College of the State Bar of Texas, Lawyers of Distinction, the Bar Association of the Federal Fifth Circuit, Houston Bar Association, the National Police Accountability Project, the National Employment Lawyers Association and is a past board member of the Houston Chapter of the National Employment Lawyers Association.
