Location: Texas My brother recently passed away without a will. He owed about $38,000 in credit card debt spread across multiple cards, and his "estate" consists of nothing but some Radiohead t-shirts and a 2011 Toyota worth $500 in scrap. My mother--the official next of kin--is not interested in probating his estate, because it would cost several thousand dollars of her money in order to help a credit card company recover $500 worth of scrap metal. There's a possibility that one of the creditors will file probate, in which case they are welcome to be the court-appointed executor and she will happily hand over the keys to the car (and the t-shirts, if they want them). The car is currently sitting in front of her house because that's the last place he was staying before he went into hospice. The problem is, we are pretty confident that none of the creditors are going to file probate. Each of them are owed less than $10K individually, so it's not going to be worth it to them any more than it would be to her. But this leaves her trapped: she can't sell the car for scrap, or even donate it, without signing a legal document that says she is the owner of the vehicle. (Junkyards/charities don't need the physical title--which is good, because she can't get a copy of it without documentation showing she is the executor of the estate--but they generally all require *some* kind of signature saying she has…

Location: Texas Her will has the house being left to me, my aunt, my uncle, and my mom. Everyone is willing to sign their parts over to me, as me and my kids lived in the home with my grandmother for the years leading up to her death. My uncle is supposed to be the executor of the estate, but we haven't started probate. Is probate something we absolutely have to do? And we just had foundation work done just a few months ago, she was making payments to GreenSky. I can't afford the same payments she was making, what can happen now?
