I really feel like I'm being discriminated against and targeted by a new director who doesn't like my lack of socializing. There was an other employee who disclosed her neuro divergence and was fired not long after and replaced with a neurotypical who the director described as top notch in a Board Meeting. Looking for advice before contacting an employment attorney. I’ve worked for the same company for about 8 years, making around $14/hr. For years they classified me as a 1099, even though they hired me, assigned my work, controlled my schedule/hours, and told me when to work. I was eventually switched to W-2 without the job itself really changing. My normal schedule was about 56 hours/week (112 biweekly) and I was not paid overtime for hours over 40. I have the payroll records. One two-week paystub shows 251 hours, all listed as “Regular” at $14/hr ($3,514), with no separate overtime line. That stub also has a separate $994 salary payment. Other two-week stubs show 115 and 118 regular hours at $14/hr, also without an overtime line. I also have another record showing 591 hours. Even using only my normal 56-hour week and ignoring the extreme pay periods, the missing additional half-time premium at $14/hr would be about $5,824/year, or $46,592 over 8 years, although I understand the statute of limitations may mean I can’t recover all 8 years. I’m also technically still employed there. My patient passed away about 2 months ago, and the company has refused to give me another patient, so I’ve had zero hours since then. At the same time, they asked me to let another person use my EVV/login to clock in under my account and offered to pay me a small amount each week for letting them use it. Location: Central Virginia I had an employer tell me that she would pay cash and I can file my own taxes as 1099 or not at all and it would be up to me. She claims on her end she only writes first names of her "employees". Online it says that if I might have been misclassified because I was basically full time. She controlled my schedule and everything we did. I did a lot of side quests for her that I wasn't really paid for. She's the type that only pays you 30 min after close no matter how long it takes you to finish the work load. She also offered to pay some of my coworkers in marijuana. She also had me sign a contract (that we notorized) that said I would get extra pay for my job in percentage to our daily profit, but she did not follow through. After she made me a GM she also wanted me to stop paying myself for inventory runs before and after close. Is there any recommendations on legal action I can take against her? Any recs for lawyers who deal with this? Is it worth going after? (I'm pretty broke)

Location: Virginia. Recently hired, this type of work doesn’t need an application so I didn’t fill anything out. Asked to meet virtually for onboarding and I thought it would be a get to know you & ask me to email XYZ documents / ID & have me fill out forms and email it back…. That is not what happened. Started asking me questions as if they were filling it out on their end. Like my direct deposit bank info: never asked me to send them a blank check. Person filled out my tax documents which I assume were I-9 and W4 based on what they were asking me. I didn’t sign anything or get anything sent me to sign. Again- literally just having a virtual call & they were typing away. Idk- seems super sketch to me. Esp since they never asked me to show my membership number for a certain program id be teaching for (it’s a sport) & ask for insurance liability documents which are required to teach my sport. It will be interesting when I get my first pay check do I just way and see or say something
