Agreements with Arkansas State Archives and Secretary of State

(a) The Arkansas State Library, acting through the State Library Board, is authorized to enter into necessary agreements with the Arkansas State Archives, with respect to an overall plan and design to assure that the functions and materials of the library and the Arkansas State Archives may be convenient to the public and public officials of this state and to its political subdivisions, and to assure that unnecessary duplication of services and facilities is minimized. (b) (1) (A) In addition, the library is authorized to enter into contracts and agreements with the Secretary of State for the custody, storage, cataloging, or display in the library or Arkansas State Archives of any books, records, documents, or other papers in the custody of the Secretary of State. (B) This shall be done under such terms and conditions as may be mutually agreed to by the parties. (2) The library is also authorized to accept custody and control over any books, records, and documents which the Secretary of State is now required by law to keep or maintain in his or her official files or volumes, if: (A) The Secretary of State shall determine that the records could be properly cataloged, stored, and preserved in the library or Arkansas State Archives; and (B) The Governor agrees in writing for the transfer of the books, records, and documents from the Secretary of State to the library or Arkansas State Archives, in accordance with the terms of the agreement made in writing signed by the Secretary of State and the State Librarian or the State Historian for the custody, cataloging, preservation, and care of the records.
